Arthur Oldner was working off duty from the Johnson County Sheriff's department at a 24 hour hamburger restaurant called the Whataburger in Fort Worth Texas.

Lawrence Timmons a disabled man from a back injury was there and started complaining about the lack of large hamburger buns.

Oldner said that he was going to arrest Timmons and took him outside. Now oldner claims that the drunk, disabled Timmons pulled a knife and took his night stick and started beating him with it.

Oldner says he was being beat with his own nightstick, by a man with a disabling back injury and who was drunk.

Oldner pulled his gun and shot Lawrence Timmons at point blank range in the chest at 3:40 am on June 9 1986. Timmons was pronounced dead at 4:30 am at John Peter Smith Hospital.

Oldner was cleared by HIS sheriffs department of any wrong doing.

Your facts are incorrect.
(1.) Officer Oldner was not an employee of Johnson County Sheriff's Department, at the time of this unfortunate incident, this fact can be confirmed through the Texas Commission on Law Enforcement Standards and Education Commission. He was employed by the Forest Hill, Texas Police Department.
(2.) He was not "cleared" by the Johnson County Sheriff's department, as this incident occurred in Tarrant County, Texas, Officer Oldner was cleared by a Tarrant County Grand Jury..
