Burning Leaves: Legal or Illegal

Can someone help me on this one. Is it Legal to burn leaves in your back yard if it is contained in a "camp fire" type place? Can someone refer me to the right web site that shows the laws for this. We don't want to intentionally break the law by burning in our back yard.

Yes, it is illegal to burn leaves anywhere in Indiana. Localities typically do not enforce the law unless someone calls in a complaint. If that happens, then the fire department will come out and put out your fire and you will be charged a fine of something like $100. However, the worst thing about burning leaves is that it is intrusion on other people and their health. Did you know that burning leaves is 20% toxic? Leaf fire is very rancid. I suggest using a mulching mower, composting, or moving them off of your property.

Yes, it is illegal to burn leaves in my own backyard. Where I was very attentive to it. So it happens, that the fire department came out, but put the fire out before they try to put it out. Question here is why is it tat I have to ask permission to burn a little open leaves in my own back yard. It was alright when I explain that I did not know; however, I was given summons to appear in court.

Please don't burn. Please. I have 10 neighbors who burn, year around. I live in the county, so unfortunately, it's legal. The smoke gets in our house and it's horrible and toxic. If you google, Is leaf burning toxic, you will find that it is, smoldering is also toxic.

Please try not to burn.

Leaf burning should be made illegal. Our neighbor burns his leaves and branches. Not only does our house get saturated with smoke, it comes in through the vents, etc., but I am highly allergic to smoke AND my husband and my son have severe asthma. We have to leave our own home anytime that our neighbor decides to burn stuff. Please don't burn. There are plenty of other alternatives to dispose of things, that is not an intrusion on everyone around you. It is highly inconsiderate!

Legal outside of the city limits, inside the city, it depends on the town. Warsaw, W. Lake... not legal.

Look it up! It's NOT legal to burn leaves in Indiana no matter where you are located. Besides being illegal, burning leaves is an intrusion on others. There is a wealthy doctor in Warsaw that has many acres of wooded land. Rather than raking leaves into the woods, mulching, or composting, he burns them instead. He burns them without discretion. Fines need to be heavier and enforcement should not be voluntary.

It IS illegal. If it is that bad, call the fire department and make an anonymous complaint. The fire department will put out the fire and issue the polluters a small fine.

@Whiners on Notice: Your ignorance is unfortunate. I was just reading this thread because I am disheartened by all of the burning that goes on in my small town. I would just like to state that I suffer from asthma and allergies, and I am by no means overweight. I am 5'8" tall and weigh 130 pounds. When people in my town burn openly in their yards, I feel horrible and have to keep using my inhaler just so I can breathe. I have also never smoked a day in my life. Being an asthma sufferer is just the hand I was dealt, but I should not have to deal with people breaking the law and infringing on others' rights to breathe clean air. My husband and I keep our home and lawn beautiful by using legal and healthy methods of disposing of our lawn waste. Kendra

You really need to think about yourselves being hypocrites. Leaf burning toxic? Come on people, automobiles are toxic, construction equipment is toxic, smoking is toxic, learn to deal with it or you're just like the snobby whiners who complain but don't have the guts to stop yourself from what you're doing wrong.

Yeah umm, have you ever seen a tractor? Or vehicle? Or maybe a city incinerator? Do you even know what that is? Do you know how natural a forest fire is? Or why we have them? How it actually saves us? Maybe you should look into those thing before speaking. I'm sorry for your medical concerns but don't scapegoat.

Leaf burners are lazy inconsiderate jerks. I wake up this morning and neighbour is burning and all smoke coming directly at me. Unfortunately it's not illegal, but that doesn't stop the smoke from filling my house before I'm even awake. You can see the smoke from outer space I imagine. How is that like automobiles or cigarettes? Yes forest fires are natural, so are earthquakes and hurricanes. Your not supposed to be 20 feet away from fire choking on it. If I were in forest I would leave a forest fire, but when it's contained in my inconsiderate neighbours yard, what to do? Anyone against my words or against words like mine, is most likely a leaf burner themselves. Let me fill your house with putrid smoke if you disagree.

My neighbor burns and the wind always blows the smoke towards my home hated it, so this I piled up the leaves packed in steel 50 gallon drum packed them in waited for return wind lit it up and it's been 2 days straight and it's still blowing smoke on there home. Payback awesome.

Actually, you wouldnt win... And to say you have is a lie... Why? Because claiming smoke damage due to a neighbor burning leaves would be a negligence issue on your part. If the smoke from burning leaves was producing an offensive enough smoke, then its your dutyas the renter/ home owner to take normal steps to avoid the smoke from entering the home, ie closing doors and windows and by then calling the fire department if it IS that bad. Why do people lie on threads when there are numerous fact checkers, lawyers etc coming behind them???
