I have dedicated many months of my time to prepare a report of sorts on the DRP. What I have discovered is that the entire fate of Texas is connected to the Surcharge Program. This is because the money from the Unconstitutional program is earmarked for the Tran-Texas Corridor, which is a strategic segment of what is to become a Super Corridor that spans the entire North American Continent.
The state is suspending people's license over not paying an excessive surcharge fee that is in addition to what you agree to in court. What's more is the money is going to pay for the Corridor projects, without consent or knowledge or the People or Congress! I believe that spreading the word would enable individuals to better deal with the negative effects that the TX DRP has had on their lives, as well as have a say in their own future.

Driver Responsibility Law
Points system
The Driver Responsibility law (TRC § 708; Article 10, House Bill 3588, 78th Legislative Session) establishes a system which assigns points to moving violations classified as Class C misdemeanors and applies surcharges to offenders, based upon the type of offense and the time period in which the citation was received. For each conviction, DPS will assign points to a person’s driver license as follows:

• Two points for a moving violation (defined by 37 TEX. ADMIN. CODE §15.89) conviction in Texas or that of another state.
• Points will not be assigned for speeding less than 10% over the posted limit or for seat belt convictions.
• Three points for a moving violation conviction in Texas that resulted in a vehicle crash.
• Effective September 1, 2005, Child Safety Seat Violations will accrue two points.
Points accrued remain on the driver record for a period of three years from conviction date. An offense committed prior to September 1, 2003 will not apply to the assessment of points under the program.
Points surcharges
DPS will assess a surcharge when the driver accumulates a total of six points or more on their record during a three-year period. The driver must pay a $100 surcharge for the first six points and $25 for each additional point.
Annual surcharges for certain convictions
Drivers who receive a conviction for any of the following offenses that occur on or after September 1, 2003 are required to pay an annual surcharge for three years from the date of conviction.
• Driving While Intoxicated (DWI), or a DWI-related offense
•• First Conviction -$1,000 annual surcharge
•• Second Convicton -$1,500 annual surcharge
•• Any Conviction with a BAC of .16 or greater -$2,000 annual surcharge
• Failure to Maintain Financial Responsibility
••$250 annual surcharge
• Driving While License Invalid
••$250 annual surcharge
• Driving without a Valid License (i.e.; No Driver License, No Commercial Driver License, No Endorsement Violation, No Motorcycle License, Operate with License for other Class Vehicle).
••$100 annual surcharge
Surcharges are automatically assessed for these convictions and do not accrue points. All surcharges assessed for this program are in addition to all other reinstatement fees required for other administrative actions and do not replace any administrative suspension, revocation, disqualification or cancellation action that results from these same convictions.
Driver notification of surcharge and driver license suspension
The offending driver will be notified by mail to the address on record with DPS of the assessment of a surcharge on their driver license. The notice will state the surcharge must be paid within 30 days to prevent the suspension of the driver license. Upon suspension of the license for failure to comply with the surcharge requirements, the license remains suspended until the person establishes an installment agreement, or pays in full all surcharges and related costs, such as service/collection fees. Individual's establishing an installment agreement will receive monthly reminders with a payment coupon indicating the amount due.
Who receives the money collected
Each surcharge collected by the Department under this law will be remitted to the Texas State Comptroller's office on a monthly basis. The Trauma Centers Fund and Texas General Revenue Fund receives 99% of the revenue collected, while DPS receives the remaining one percent for the administration of the Driver Responsibility Program.
If you look up and read Article 10 (sec. 780.004) payments form the account, describing the DRP, you will see that the money doesn’t just go to the trauma center. They must apply to receive funding and they must be exempt from federal income tax and aid. They are certainly not guaranteed to receive funding.

Half of the funds go to General Revenue and ultimately the Texas Mobility fund, and the other half to Trauma Care centers. The TX mobility fund is the top priority, so the state is using the money for unauthorized Toll construction purposes.
Who receives money from the surcharges?

Each surcharge collected by the department under this law will be remitted to the Comptroller, on a monthly basis. Trauma centers and county and regional emergency medical services will receive 49.5 percent of the collected money, and the Texas Mobility fund will receive 49.5 percent of the collected money. The money that goes to trauma centers will be handled by the Texas Department of Health, while the **Texas Department of Transportation ** will handle money going to the **Mobility fund**, which funds highway projects, including the **Trans-Texas Corridor**. The remaining one percent of the collected money will go to DPS for operation of the Driver Responsibility program.

The Driver Responsibility Program was passed into law as part of House bill 3588, article 10.(text of the law - http://www.capitol.state.tx.us , p.152 of Adobe.)

And there are thousands that are driving now, with this surchharge and only find out until you get pulled over or renew your license! I transferred this from another town in Texas, because we got to get it out there! I had my DL taken for two years and when I went to get it after two years,, on top of the punishment, or fines received when I had them taken away! This is unconstitutional on so many levels! This is totally obsurd....How in the heck are you going to make cars that go 110 to 160 miles an hour and then tell people that they can't go over a certain speed limit. THERE IS A MIX UP SOMEWHERE. Not only that, you are making people pay an extra fee after they have paid the ticket. TEXAS SHOULD BE ASHAMED OF THEMSELVES...BUT THEN AGAIN, THIS IS TEXAS, NO THEY ARE NOT. THEY ARE JUST PLAIN STUPID AS HELL.

i wanna know whythe hell does it take so long to reinstate your license after you pay the surchrge in full i mean you pay the ticket then you give them money for their surcharge and you still got to wait about two weeks toreinstate your license

i have 2 dwi's the second one i got i was standing in my front yard . some body called in and gave them my license plate .they were waiting for me when i got home ..i couldnt aford to take it to trial so i was convicted .i was under the impression that the surcharge payments were dismissed due to some lawyer making a change for the people of texas. i can do the time ass hole thats not a problem but i cant aford to pay the city of fortworth 1000 bucks then pay the state a 1000 bucks a year. does that make sence mad dog earl??? im sure you have had a few beers and drove just like me but you havent been caught . when you are caught you will be in the same boat as all of us

My friend I agree but this is an unconstitutional law! Its been found unconstitutional in 2 other states that enascted ot! Forgive me but I cant remember which, but I believe New Hampshire and Deleware. Nevertheless, the Texas Legislature has had such a backlash from this law they gave amnestyto 650000 Texas drivers paying this. That is if one heard about it. I happened to and retained my drivers license Thursday, and its a prayer answered. I completely agreeDONT DO THE CRIME, etcetra as you have stated but its double jeopardy among many other things! Say you get a DWI, you get jailed, then probation or worse, lose your drivers license for two years and when you go to get them you owe up to $2000 a year as a surcharge to the state. And you never hear anything about it until its time to get your DL back. A Texas Senator Shipliege has been spearheading this effort and we are making headway. The Texas Legislature should be repealing this very unconstitutional law very soon. I wish you all luck and yes I have my DL back but will be still doing my part in seeing this law repealed. I would like to see some restution, but that will never happen. Have a blessed weekend friends!

My son has just had his license suspended for failure to pay a surcharge that he never even received notice of. This is the second time his license was suspended this year for the surcharge program. We just paid them in March of 2011 and paid everything to get his license back. Now they say their is another surcharge that he owes that wasnt included in March. NO NOTICE WAS SENT AGAIN. Now his job is in jeopardy as he has to drive a company vehicle. He has never even had a DUI or DWI; this is all from old traffic tickets which were paid and then later assessed points.

There are currently a million texas drivers that this absurd law is affecting the same way and needs to be repealed.

me and my wife both had our license suspended
my wife was from a no insurance ticket when we had insurance the day we were going to court it iced over
tried to call court courts were closed that was on friday called monday mourning was told we were to late so we just paid the ticket month later got the surcharge letter week later wife got pulled over for front license plate not being on found out drivers license were suspended and now more surcharges
mine were over "many tickets" the last ticket i had was a year ago no warning besides the letter saying i had no license now neither of us have a license and no obvious crime i think the state of texas has abused its power and am all for getting this law kicked out

i have 2 dwis and a driving while dl suspended....somehow these offenses have built up my surcharge of $9,400! with no license 2 drive 2 work it will take me many yrs 2 pay this having 2 walk 2 the closest place 2 my house that i can work which is minimum wage fast food!!! wtf is wrong with the law makers who r doing this 2 us. we vote for these people and then they screw us every chance they get!

I just moved back to Texas and went to change my dl over and was told I have surcharges. All of the surcharges were for when I was out of state and with another states dl. There was evidently one for points and the other three are for getting my dl suspended from the points. I did not even live here or have a Texas dl to get suspended.

I just got a ticket for suspended license because of a surcharge. I was in the military at the time they suspended it and just got home . I had no idea. Now I'm gonna have to pay this surcharge plus the suspended license surcharge. Great

i was caught with a suspended license because my payment towards my surchange was not there on time after that i received my commercial license now they want to suspeded can i receive probation insted of the suspension

I'm about to shoout AG Gregg Abbott an email. I agreement w/him about the unconstitutionality of mandate & Obamcare but I want to ask him why isn't this ludicrous law unconstitutional! If over 2mil people aren't paying than millions are. If a candadate for AG or Governor had all those votes they would win by landslide! Its been ruled unconstitutional in only 2 other states that tried it!

wow, I knew those surcharges were a pain, I hope they do eventually Rule, and remove the surcharge process. I
