John Hunley appeals an order denying a petition for writ of mandate.  (Code Civ. Proc.,§ 1085.)   The petition sought an order directing Darrell George, the city manager of the City of Duarte, to enforce an order issued by the City of Duarte Architectural Review Board directing Hunley's neighbor, John Hardin, to comply with a City of Duarte (City) building code provision that limits the height of fences, hedges and walls on rear and side residential yards to six feet.  (Duarte Mun.Code,§ 19.24.050 , subd.(h)(3)(A).) 1

The trial court denied the writ petition, ruling it lacked authority to order the City to prosecute a code enforcement matter.   The trial court also found the evidence presented in opposition to the petition showed the wall substantially complied with the code.

On appeal, Hunley contends the trial court relied on a false declaration submitted by the City to show the wall substantially complied with the code and this case does not present an issue of prosecutorial discretion but enforcement of an existing order.

We conclude the trial court properly denied Hunley's writ petition and affirm the order.

As if New York doesn't have enough crooked politicians of its own ...

The bright lights of Broadway beckoned corrupt California officials to cross the continent and spend taxpayer money on nights at theaters, baseball games and pricey dinners at the Big Apple's finest bistros, authorities charged yesterday.

The four were from Irwindale, a bustling metropolis of just over 1,400 people where the main entertainment is watching cars at the local speedway.

The bureaucrats and politicians did have enough taste to pass on Los Angeles, just 20 miles away, for the allure of the world's greatest city.

They were busted yesterday for misappropriating public funds to finance the trips, which took place between 2001 and 2005.

They claimed they had to come to New York to pitch for a higher municipal-bond rating, and they did manage to squeeze in some time on Wall Street when they weren't hanging out in Times Square.

They lived high on the New York hog, staying in five-star hotels, guzzling $250 bottles of wine and spending evenings on Broadway watching "Mamma Mia" and "Phantom of the Opera," authorities said.

"Mostly they partied quite a bit," Los Angeles Deputy DA Nipa Cook said.

"They spent money on Mets and Yankee games and Broadway shows."

Councilman Mark Breceda, retired City Manager Steve Blancarte and retired finance director Abe De Dios are charged with five felony counts. Former Councilwoman Rosemary Ramirez faces one count.

Prosecutors said the officials used public money to pay for $250 Yankee tickets; $260 tickets to "Follies" on Broadway and $1,027 for brunch at The River Café.

On a trip in 2003, they had only eight hours of scheduled meetings, yet they spent six nights at the lavish Ritz-Carlton, checking in on a Saturday night, even though no business meetings were scheduled for Sunday.

They also saw a matinee of "Jackie Mason's Laughing Room Only" followed by dinner at Atelier on Central Park South.

Former Councilwoman Rosemary Gutierrez, who came along on one of the trips but was not charged with a crime, justified their actions by saying New York is an expensive place to do business.

"It's not like we were meeting in Irwindale or in the state of California," she told reporters. "It was New York."

IRWINDALE - City officials are investigating senior housing policies following complaints at recent City Council meetings over a housing subsidy the city pays for a councilman's mother.

Several speakers at recent council meetings have complained that the city's Las Casitas senior housing complex is intended for low income seniors, and they claim Councilman Mark A. Breceda's 82-year-old mother should not qualify.

Breceda, one of two current and two former city officials awaiting trail on charges of embezzlement, vigorously denied the claims in a telephone interview Tuesday.

He said his mother is living off Social Security and receives no income from a business in which they are co-owners.

"She's 82 years old, and all she gets is her Social Security, that's it," said Breceda. "She has nothing."

According to documents produced by Northridge Group Inc., the Big Bear Lake firm oversees the certification of eligibility for residents to live at the senior home, Breceda's mother, Stella Breceda, pays $56 a month rent, one of the lowest rent rates for any of the complex's 26 units.

The city pays a subsidy of $444 a month to cover the balance of her rent, according to the documents.

In Las Casitas' annual recertification 2012 report, Stella Breceda reported 2011 annual income of $6,936.

Tax statements were not provided because the tenant's income level did not require filing taxes, according to a 2012 Irwindale

Housing Authority document.

Stella Breceda also is co-owner of an Irwindale business, RR&M Truck Parking, 200 E. Live Oak Ave.

The business occupies several acres of dirt, broken asphalt and gravel land used for storing big rigs and other vehicles.

It's on the west end of a long strip of automotive, muffler, and gravel businesses that line the Arrow Highway-Live Oak strip south of the Santa Fe Dam. The business is tucked between Peck Road Gravel Pit and a 1-800-TOILETS sign on United Site Services' storage area for portable toilets.

A representative at RR&M said Breceda instructed him not to give any information about the charge for parking at the facility or how many vehicles use it.

In the subsequent telephone interview, Breceda said his mother is listed as co-owner in title only and does not receive any income from the business.

"She has nothing to do with the business," he said.

According to a City of Irwindale business license certificate issued July 1, 2012, the business owners are Mark Breceda and Stella Breceda.

Mark Breceda, in his Feb. 1, 2012 statement of economic interests for the Fair Political Practices Commission reported annual income of $10,000 to $100,000 from RR&M.

He also listed two properties in Irwindale, each valued at between $100,001 and $1million.

At its Feb. 13 meeting, the City Council voted 3-0, with Breceda and Councilman Manuel Garcia abstaining, for staff to give the council a comprehensive report March 13 on the senior housing program and the process for certifying residents' eligibility to live at Las Casitas.

I will recommend all the readers to see what "Go Army" and "Hunley sucks" have to say about James Hunley who goes by CarParker. He has been exposed as the racist, vindictive, criminal that he is. I applaud Go Army and Hunley sucks. They have seen the CarParker in is true color. And my respect goes out to Go Army and rest assured, though Hunley was in the military, I do not recognize him as a defender of freedom as I do you. Read them under the topic, "Where is J Hunley".

Then along comes James Hunley and he discovered that they were embezzling city money and reported it the the D A. Charges were filed and they were arrested. and are now awaiting trial. Breceda's family that post under Go Army, Hunley Sucks and National Anthem have their panties in a bunch. As every one can see they are defending crooks. And that says a lot about their character.

I would rather read why you are considered non credible. Judges, newspaper reporters and the general public all agree. HUNLEY IS NOT CREDIBlE. Tell us Hunley, how did those cases turn out for you? You know the ones, law suits where the Judge reprimanded you for lying, the criminal case that sent you to prison, the law suits that you lost regarding your neighbor. The one where you jumped the wall and looked into your neighbors windows. And if course, the one where you were issued a restraining order, ordering you to keep away from a poor little girl. What is it? 50 or 100 feet that you can't get near her.
