Absurd. Franz will never prove Shaw's liability in court. If Mr. Franz learned that eating fish was "part of a healthier diet," he could just have easily learned of the risk of "tapeworm from eating undercooked fish." Mr. Franz could have ordered his fish thoroughly cooked (like I do) but choose not to, thus accepting the risk of tapeworm, etc. Why let greed ruin a fine restaurant's reputation?

Shaws, please don't pay this guy.

Shame on you, NBC. Sensationalism reporting, scandalous headline. Don't you think the court should decide where Mr. Franz got his tapeworm, or are you going into the judicial decision-making business?
