Breath tests don't always apply to these people. Many are exempt from our laws. This is a small town Mayor, perhaps he wont get the Teddy "Above the law" Kennedy treatment. I mean what kind of self serving @#$#@ gets ripppped on booze, lures a young woman in his car (with his money & power staus) & drives into a lake. Then, he has the nerve to go home & sleep it off. He didn't even ask anybody to see if the woman was still alive,no he waited till the next morning. Teddy never even received a court date. We all know they are exempt from our laws in Washington. Their ceo buddies aren't even held accountable for failure. It's a perfect world for them. Meanwhile theres a guy who just received 23 years for this crime here in Oklahoma. Violent armed robbers who shoot people get off with lenient sentences here. Murderers who intentionally murder get slaps on the wrist here. What's even worse is they let child molestors & child rapists walk. If he's buddy buddy with the system he'll walk. If he's traeted like one of us regular people he'll get life+years for an accidental crime. These okie justices judge according to their pockets I guess? Oklahoma's system is now infamous

I did not read anything about this man being drunk, maybe he made a mistake and did not see the stop sign? How can you judge him with out all the facts? I am sure many of us have been guilty of makeing a mistake while driving. I am not saying he should get off free and clear, but accidents do happen, and mistakes are made with out drinking always being the factor.
My prayers are with the victims family.

Are you serious? CITED??.. any other citizen would have been arrested on the spot and thrown in the slammer real quick! That's crap! NO ONE Should be ABOVE THE LAW! There is a dead man here! A family without a father, son, brother. And because it was a mayor, there will be no justice served! The "mayor" ran a stop sign! He was more than negligent! Running a stop sign is intentional! He should be charged with Manslaughter in the 1st degree!!

Prayers be to the family of this innocent man that was killed. I hope you receive justice in a fair manner.

I think the media should get all of the facts before putting it on the web site. Read the Claremore Paper to find out the facts of the OHP report. OHP investigated the accident not the local police because of conflict of interest, It did happen in the city. Read the facts before you judge

you guys do not know the facts, the facts are it was foggy that morning, the motorcycle did not have a working headlight and the "mayor" just simply did not see the motorcycle. Mistakes do happen, that's why they're called ACCIDENTS!! the comments made on this forum really explain what kind of people write in these. This is my first and last time to comment on this!!!

That is not true all together, there was a teen here that ran a stop sign and killed a person, and all they got was cited. No charges were filed, and the kid got away with it. It was an accident, not paying attention, it happens, not everyone on the road is a perfect driver, we all make mistakes.

In response to Connie, They never arrest someone on the spot for negligent homicide,unless they are d.u.i. or something else. The neglegent homicide is up to the d.a. to decide and only the d.a. that is not up to the police. You guys really need to know what your talking about before you start spouting off at the mouth.

If there wasn't a working headlight on the motorcycle, would it be fair to put some blame on motorcyclist? Personally, I'd be p1ssed if I had to spend the rest of my life knowing I killed someone because that person drove in the fog with no headlights putting drivers in an unsafe position. What if the mayor had died, would we blame the guy with no headlights then?

yep everyone would, the blame has to go somewhere, and with this guy being a mayor of a town he will get the blame the most, I think it is a shame that it happened at all, I think it was truely an accident, but I was not there, so I guess I really do not know...

I in no way think that the Mayor planned to killed my nephew, my Siter's only child, however, it was careless driving. The Mayor and the two young girls in his vehicle learned a very costly and deadly lesson that day and I hope they will be better drivers because of it.
The Motorcycles lights did work and the lights come on automatically when you turn the key on. They invested the bike and found nothing wrong with it.
This is a very Tragic thing and a Huge, Huge Loss of a a great and loving person whom everyone that new him loved him, and No-one is assuming the Mayor to have been drunk or anything else.
Blaming or pointing fingers will not bring James back to us.
All we can hope or ask for is for Justice to be served appropriately, whatever that may be!

Thank you for clearing up any speculation regarding the motorcyclists' fault. What about the breath test? This should merit one. If it was anybody else they would be tripping all over themselves to prove guilt by alcohol. two girls?
