Claim: I was sterilized against my will

A 35-year-old mother of nine is suing a Springfield hospital, three doctors and two nurses, claiming they permanently sterilized her against her will, violating her reproductive rights, according to a lawsuit filed in Superior Court.
Tessa Savicki, who has nine children aged 3 to 21, claims doctors were supposed to implant an intrauterine device, which is a type of reversible birth control, after she delivered a son, Manuel Flores, on Dec. 19, 2006, at Baystate Medical Center.
Instead, she said, a type of permanent sterilization known as a tubal ligation was performed, leaving her mentally distraught and incapable of bearing more children.
“There was no medical reason for them to do this,” Savicki told the Herald.“That’s my choice. This is my body. I wanted the IUD so later if I felt I wanted more children, I could have more.”
Savicki said she did not sign a written consent for a tubal ligation, which under federal and state regulations is required at least 30 days in advance for all MassHealth patients who want a permanent sterilization procedure.
Post-delivery notes indicate she received a tubal ligation, the complaint says. The surgical notes were reviewed by the Herald.
This is the second time Savicki has sued over reproductive issues. In 2001, she reached a settlement with CVS and a spermacide company after she became pregnant with her now 12-year-old daughter after claiming she bought and used an expired spermacide, according to federal court documents.
Savicki has nine children from several men, is unemployed and relies on public assistance for two of the four children who live with her. She receives supplemental security income, or SSI, for a disability, non-Hodgkin’s lymphoma, she said. Her mother has custody of three of her children. Two of her children are no longer minors.
‘It’s my choice’
Savicki acknowledged that some may feel little sympathy for her situation, but cautioned against public judgment because she is a poor, unmarried mother of 9.
“I would never have the right to tell anyone else ‘because you have this many kids that’s enough,’” she said.“That’s no one’s right to say that. It’s my choice. No one has the right to say you’ve had enough.
“I take care of my kids. I love my kids. I was not ready to make that kind of decision,” she said of the permanent sterilization.
Savicki said her life has stabilized in the last decade after a rocky start. She had her first child at 13 and dropped out of high school in the ninth grade.
Savicki said she’s been in a relationship with her fiance, Angel Flores Tirado, 36, since she was 25. She lives with him and the couple’s three children. Tirado helps support the family with his full-time job as a personal care assistant. Savicki said she’s had eight of her nine children while in committed relationships and hoped for one more child with Tirado.
“It’s not like I’m jumping from guy to guy to guy to get pregnant,” she said.“I’m trying to make a healthy home for my children.”

Yeah, she may be a welfare queen, which you obviously find morally repugnant. However that does not negate the issue of tortious battery as a legally compensable wrong. Say what you will, but if the State gives imprimenture to this conduct, it could be forced sterilization today, euthenasia tomorrow. Pull your head out of your ass.

So glad they did this to her. I tired of paying her salary to raise her children. I believe it should be mandated to sterilize a woman on welfare after 2 children and mandated on every woman who has had 3 children married, not married, on welfare or a CEO of a large company. The world is over populated now. China has the right idea!

I hope these doctors get an award. Anyone who gets pregnant while receiving net government aid (more aid than taxes paid) should have a choice - sterilization or no more benefits. Ever.

How did she get this far in the game without intervention by welfare? she's playing the game by only having 2 at home at one time. I'm willing to bet that her mom gets the welfare for the other three and this freeloader collects for the 2 that live with her. Her boyfriend works and lives with her, and thats not legal either so now that the story is out, there is no excuse. Wefare workers, please pick up the newspaper, read the story and fix this.

As Long as the men are sterilized as well once they have 2 or 3 children. It has to go both ways. Too many men are out sleeping around with anyone making babies with them.

I'm all for helping people out in times of trouble. However, I am not in favor of paying for a lifestyle and supporting parasitic leeches. At what point should we stop paying for her breeding habits? Just another example of someone believing that the world owes them something. Time for her to get off her duff (or back) and work for a living. Have as many children as you want but don't expect others to foot the bill.

This woman is what is wrong with our society. Sit on your butt all day long and have tons of kids and the hard working tax payers will take care of you. If she does win any money the judge should order her to pay back the state. Stupid idiot.

I know this woman better than anybody investigating this story. I am her daughter. The truth is that Baystate is at wrong in this matter. I know this because I was there with Tessa for everything. However, I also know how she lives her life and I truly believe that this was a blessing in disguise. I think that she should NEVER be allowed to have childeren EVER. She has nines children as it is and can't even take care of them. She is trying to make people believe that she is trying to improve her life but its far from that and much much worse. People need to know that she is a professional scam artist and dumps her children off to other people when she is ready for a new man. Tessa nor Angel have jobs. She says that Angel has a job but really it is a PCA job that is supposed to be for her and they just recieve the check. Don't fall for this scam!!!

Let's go a step further. Let's sterilize everybody as soon as they reach puberty. The next step would then be to require anyone who wished to become a parent to take a series of classes and tests to prove that they are both capable of raising a child. Only those who graduate from the class with sufficient marks would be eligible to undergo the reversal surgery (offered free to class graduates)that would permit them the right to reproduce. I know it sounds harsh, but I've see too many stories and reports about children being abused by parents who got mad, or children dying from abuse and/or neglect.

Why don't they sterilize the men that keep getting her pregnant instead. Why is it that women are to be blame. If a woman decides to have all the children in the world leave her alone. You have the right to have children. Everyone has the right to have as many children as they want. Whether they are on welfare or not. Bringing up children on welfare doesn't mean that this woman will always be on welfare. Maybe she will get off the system when her children are adults. Maybe they will take care of her. Some children do take care of their parents. You people always think about the worse. It's a shame.

Whether I'm in the system or not it doesn't mean that I'm less than a person. People shouldn't be ashamed of getting the help that they need. Robbing or killing people for getting money is not an option.

When people retire they get on the system as well. You can't judge everyone. Even when you're disabled you have to get on the system for financial help. You can't do it on your own. You can criticize all you want, but one day even you will need some help.
