Police Investigating Shooting In Old Port

Portland Police say James Sanders, 27, was shot around 1 a.m. after two men got into an argument outside the "Cactus Club" at 416 Fore Street.

How can this guy only be charged with aggravated assault when he left the bar, went home and returned with a gun? That sounds premeditated to me. James is now paralyzed and his life is changed forever.
