If the commissioner is that powerful she should pass a rule that says if u work for Murray County, u must live in Murray County. With the unemployment rate as high as ours u would think Langford would have put someone here to work. After all we do have several retired troopers here.

It is not a violation of any law to require someone working for a county agency to be a resident of that county. I am aware of several counties in different states that have just such a requirement.

If you know of such counties please list them so I can check. I know policemen that live in Murray and work in dalton, live in chatsworth and work in ellijay, deputies that live in Murray and work In Whitfield. It is discrimination to not hire someone because of where they live.

Doing away with a position means no one outside of the Dept can be hired to do the same duties if a job is done away with someone already in the Dept has to assume the duties excellent lawsut for an attorney especially if someone younger is hired to do the same duties just saying

Read the laws concerning the sheriffs. If you read the law you will understand. The non payment of the swing shift employees was stalled because the county did not get permission from the sheriff to pay them back pay. The Sheriff's Dept runs itself and makes there own employee rules. Read the employee handbook for the county and for the sheriff's office.

Georgia law states that a new sheriff can demote or fire any employee's and they cannot do anything about it. He does not have to promote in the dept and sometimes Ensley did not promote in the department or promote based on seniority or even the best person for the job. Sitton was allowed to retire and that way he can keep his post and work for another dept.

Note that I wrote Office of Sheriff and not Department of Sheriff. The Sheriff is a constitutional officer deriving his or her powers from Georgia’s Constitution and common law. The Sheriff’s Office is not a department of county government, and the Sheriff is not subject to the county government; a fact often lost on county governments. The Sheriff is the chief law enforcement officer in the county. Sheriffs and their deputies have statewide jurisdiction.

The Sheriff is an elected position serving four year terms. Due to the elected nature of the office, the Sheriff’s Office is directly accountable to the people which it serves. Some offices are completely “at will” meaning that all employees serve completely at the discretion of the Sheriff. Others are set up so that the Sheriff appoints certain members within the organization. Either way, a new Sheriff coming into office is likely to lead to a transformation of the office; so, it is easy for the people to directly voice approval or disapproval with the service being provided by their Sheriff’s Office via the voting booth.

Georgia law States several things Murray county ignores just saying Georgia law is not Murray county law every entity has policies and procedures that must be followed I could keep commenting to you but you have no clue and you are a waste of my time more lawsuits are coming just saying

Read the above post on Georgia law. the sheriff's office is independent of the county. That is Georgia law.

If there is any truth to it there would be no such thing as a wrongful termination suit against the county or the sheriff's dept,correct????
So I would like to see the rule in black and white
just to satisfy my own wonderings about it.

The only forms of discrimination that are unlawful are race and age.
Where you are from is not one of them.You can only hire local people if that is what you want to do.
Sooner or later every Sheriff realizes that they get better results from Deputies that are from out of the County. Especially when it is a small county and everyone knows everyone else.

Look at the Ga state Labor laws. Georgia is an at will State which means you work "at the will" of your employer.County employees fall under the same laws unless they have a merit system which Murray County does not have. They do have some protection by policy but not very much and the policy could be done away with at any time the Commissioner wanted to do away with it.
If they want to fire you or lay you off they don't have to give a reason. Just reduction in force if they wish or anything else they want to put down. Discrimination by race or age is the only thing that is protected by law.
There is no such thing as the "labor board" to appeal to like many people believe. You can appeal a termination but if it was not age or race related and you can prove it you will get nowhere all you can hope for is the employer won't show up for the appeal and the Employment officer will approve you for unemployment payments or the Employment officer will be sympathetic to you and allow you to draw. You will not get your job back unless the employer agrees to re hire you.
