The old "homosexual panic" defense, how original.

He deserves life in prison with no chance of parole. I hope that's what he gets.

He'll have plenty of opportunity to learn what REAL homo-panic is like in prison!

I must confess that as angry as I am about McInerny's actions, I am not comfortable with sentencing a 15 year old, fucked up kid to 25 years to life in prison. I wish the Queer community was better than that. Especially because some of his anger may come from his own repressed homosexual feelings.

I'm not at all pleased with the idea of my taxpayer dollars footing this demon spawn's room and board for the next 25 years.

What he did was premeditated, callous, and unspeakbly brutal. I'm generally in favor of the death penalty in cases of capital murder... and I don't think his being 15 makes any difference. 15 is the new 25.

But if we won't give him a lethal injection, then let's at least give him 25 years of full-time community service in homeless shelters for LGBT youth. The punishment should fit the crime.

I think that many other factors should be taken into account, especially those that bear on rehabilitation. I don't think extracting punishment--which is always part of sentencing--is a good reason to hold this young man for a long time. However, he did commit an adult crime. If rehabilitation seems unlikely, he should be kept out of society.

Brandon McInerney acted on the white supremacist philosophy. At 14 he knew what a gun could do. He decided HE had the RIGHT to end another person's life. This was premeditated murder.

Teens in this country are not the innocent little angels people like to believe them to be. And many nowadays laugh at adults, knowing they are still considered "juveniles" and that at 18, their criminal history "goes away".

I'm trying very hard not to hate the defense attorney in this case. He is doing his job. Yet it still disgusts me. And the incident with the brother addressing the jury in open Court, in my mind, should be grounds for a new trial with a new jury. I seriously doubt the defense attorney was that surprised by the brother's action.

RE: the actions of the brother. The case was moved to Los Angeles County for trial after many delays.

I believe this was a planned event by the brother, his mother and their attorney.

Spare me the broken home sob story.

I think you are all forgetting the LAW. It doesn't matter what you THINK he should be sentenced to. If convicted, he faces a MINIMUM of 53 years in prison. The maximum for him is life in prison with no parole.

Considering his present age, and the MINIMUM sentence if convicted, which he almost assuredly will be, he will be AT LEAST 70 YEARS OLD when he is released from prison, IF he lives that long.

I wish I held your certainty. I remember Dan White's 'conviction' all too well.

Then they should ban him from eating twinkies in jail.

He will get off free and clear. The press is already demonizing the victim as a sexual predator. It seems one can't tell straight people you like them , or ask them to be your valentine without being guilty of sexual harassment. We get no justice in the courts.

He's not going to get off. He will be convicte dof murder, and get at LEAST 53 years in prison, and probably life without parole.

I, too, would have expected our community to be more circumspect about McInerney's prospects. I guess this does away with the myth of the bleeding-heart liberal queers.

I agree with the jury's decision. The prosecution could not prove 2 ESSENTIAL elements of the alleged crime:

1. cause of death

2. manner of death

Ther is NO evidence that she was murdered at all. No evidence was prsented in court that she was murdered.

Not only do I think that the jury got it right, as a matter of law, I think they got it right as a matter of FACT, because I don't think that she murdered her daughter.

If you disagree, why was no PROOF offered by the prosecution ?
