Now Native and Dude,...I will agree with you both that it "wont go well" because most police will do what they are told even when they know it is wrong or even against a OAG opinion on the law itself but I do have to agree with you it certainly wont go well, because Someone will get a wrongful ticket...have to take off from work and lose a days pay in bad economic times, and possible even risk their employment, sit in court and possible, if they are naive or ill prepared have to pay a fine that many cant even afford. So, yes, do LOL all you find appropriate.
one would wonder why they expose themselves to such hardship just to protect you from you own stupidity.
This harkens back to the early days on the plains of Africa...the old, injured, unbright soon become lion food.

You are very brave and considerate...especially since you call working for time and a half a "hardship" The hardship is the poor working stiff who gets the ticket from a time and half cop illegally. I can see you didn't comment of the OAG opinion link? Let me guess...you dont respect the opinion of the State Attorney Generals office either...but get a woody by giving a ticket.

I have read OAG's opinion and understand it fully. It is also noted that Judges practice on a wide field when ruling on these cases. I wear my seatbeat at all times because of the protection I believe it provides and hope that you do as well althought I suspect not. Don't forget to let us know how this goes when you are in a traffic check without a belt. And last of all, what gives me woody is not a concern of yours but thanks for the concern.

No, I get your point; the current statue as written does not allow the the police to issue a ticket for the lack of a seat belt when that is the only thing wrong with your driving behavior or your equipment.

stupidity shouldn't be a crime unless it infringes on other's civil rights.

Of course, that has little to nothing to do with the point that native and I are making. Innocence is hard to prove after the fact, just read up on NY's stop and frisk laws.
