PARDON, Chief, but Virginia hate crimes statute does NOT protect orientation. Also, Virginia's Human Rights Act does not protect orientation.

Hate crimes are defined in Virginia law as:
•a criminal act committed against a person or his property with the specific intent of instilling fear or intimidation in the individual against whom the act is perpetrated because of race, religion, or ethnic origin or that is committed for the purpose of restraining that person from exercising his rights under the Constitution or laws of this Commonwealth or of the United States,

•any illegal act directed against any persons or their property because of their race, religion, or national origin, and


•all other incidents, as determined by law enforcement authorities, intended to intimidate or harass any individual or group because of race, religion, or national origin.

And incidents like this one are exactly why this omission is a mistake.

Bob McDonnell put Virginia severely behind the curve on this issue when he became the first VA Governor in 30 years to remove sexual orientation from the list of protected classes.

The Supreme Court has previously struck down similar anti-LGBT, discriminatory-by-omission state statutes (Romer v. Evans, 1996) because they are in violation of the Equal Protection Clause of the 14th Amendment.

Furthermore, since the Shepard Act in 2009, federal law is very clear on this issue. VA is behind the curve.

the 15th was a football game night which brings out all kinds of anti-gay people who live in the nearby counties

This is so disgustingly P.C. Well, what do we expect in Cville. The fact that a sworn police officer writes a report like this speaks volumes about the state of things on grounds. Funny, isnt't it?

Easy pull kids out of school, load up parents and pick a place to go. Not that I really care if you or anyone stays or goes, but it can be done.

Not sure if this was hate or if it was just violence in general, but people who punch other people normally talk a little trash. Not that it's right but it is what it is. I just find it sad that if you are straight and white and do anything to someone who isn't you are considered to do it out of hate. Just because your stupid, doesn't mean you hate. Law should be simple, you randomly punch someone, then you get punished, not punished worse because someone is tring to tell what another is feeling inside.

So, if the suspect did not yell a slur, does it still make it a hate crime or just a random assult.

Silly if you ask me. An assault is an assalt. I'm pretty sure whenever someone assaults another person, 99.9% of the time the suspect is yelling a racial/sexual orientation slur.
