I have been trying since May to get the child advocate office to track down my son's father to help me get child support. I explained to them he had walked out 10 days before our son was born. Actually I started trying before May but they couldn't help me since I didn't know where he was at. So I had to track him down on the internet which was not easy. I finally found voting records from the state he was living in and got an address off that. I took it in and since I had that they were willing to help. THEN they had to delay things because from where I had a medical card about 8 years ago, they still had records for me but the records were located in another county - I asked why since I had never lived outside the county I now live in and they argued with me that they did not make mistakes and I had to have lived in that county for my records to be there. WRONG! But they wouldn't listen. Then it took from May to November to get the DNA test done, now they say they mailed my results a month ago to their attorney's in Charleston and it could take until the END of 2008 to get into court to get child support. This is uncalled for. I work but HE has a responsibility as well to help care for his son. Is our court system really this backed up or is it just a matter of people not putting in a full day of work so matters like this get shoved to the side? If our government does not want people getting help through the welfare office then FIX the child advocate system & the family court system.

I hate to tell you this but if u live in the state of WV u should just forget about getting anything done when it comes to child support I have a 13 year old son that I have been fighting for child support since he was 2 months old and I bet I have gotten a total of 2,000 dollars of it since he was born he is in arrears like 18000 dollars and no one cares cause of one fact if u think about this u will say i am right no matter who u are when it comes down to it if u work for the state u are going to get ur check no matter what but they don't care if u get the money to pay for ur child cause they don't have to pay it if u are working then u can't get welfare to help u or if u live with someone then u can't get welfare either cause of the household income and that isn't ur fought that is the states fought for the laws that they have so it points back to the state again and there isn't one news station that will check in to this fact either i have done everything to get mine down to calling and writing the president of the untied states and the govorern and that don't work wither u can contact me by e mail i might be able to help u get if done faster i no a few tricks my email is [email protected]

I know for a fact that in WV, once the order is in place, if they don't pay for 90 days, their license is suspended, if they owe over 10000, there is a warrant out for their arrest. They don't joke about that one. There is also a law in WV, that if no court action has been taken in 10 years, it nullifies the order, meaning you are no longer owed anything.
As for Child Advocates, they don't know what they are doing. They really need to overhaul that system big time, not just in WV, but nationwide.
I know someone who has given the information to get their child support from the taxes and they were told "can't do it the way the taxes were filed", BULL.
Unfortunately the only suggestion is for you to get a lawyer on your own, because the lawyers for child advocates do not represent you but represent the state.

I know that the child advocate people are rude. They could not care less about children getting any support. I am just aggravated because I've had to sit and wait while personal phone calls where made & taken - where I work you do that on your lunch/break or when NO ONE is waiting to see you. The father lives in NC and they have told me if I can just get them an order that he is to pay the support, they will help me but I can not get WV to move - I bet that if the child advocate people needed their support then they would be moved to the top of the list. I am almost to a point where I just want to drop everything because they just won't do their job. The do need to overhaul the system and they also need to make people accountable for their actions. How long does it take for an attorney to read a paper and set up a hearing? It does not take months. I have worked as a litigation manager in the past and read numerous court orders from the supreme court (as well as local courts) and I was still able to keep up with the orders - this is uncalled for.

does any body know about the child support enforcement office in texas can they arrest you in another state even if your case has nothing to do with texas.

Hey smart mouth! I WORK and HAVE worked since my son was born because of a lazy good for nothing man who don't have to backbone to help pay for the child he helped create! Too many of you MEN don't want the responsibility of anything once you get out of the bed! You MAKE ME SICK with your attitude - most women have to work because of DEADBEATS who want to take the easy road out. You NEED to get a BRAIN before you smart off at people because some of us WORK to support what SOME OF YOU MEN won't! Get a life and think before you run your stupid mouth!

Sure there are a lot of deadbeats out there, but like Judge Judy says, "you picked 'em." People need to make better choices in selecting their mates before they go about reproducing.

You must be a piece of work because I have read you righteous comments on other forums. Yes, we pick them but people also change. Do you honestly believe that women would pick a man, marry him if they KNEW he would snap one day and beat the heck out of them or kill them? No they don't - sometimes some people (men & women) are great when it comes to hiding who they really are - I really feel sorry for anyone who has to be around you on a regular basis because you must be a real pill to be with.

Every payday child support payments are taken out of my check also spousal payments,ive been this for ten years,Well here goes belive it or not,child support principal is $197.65,interest on this is $25,975.50,Spousal principal is $3,784.80,,,Interest on this $23,734.49, I live in Ohio and im 61yrs.old.........And cant get help on this nightmare from anyone.???????

I have no clue about the spousal support. I don't believe in it if the woman has a job. BUT if a man (as in my ex) does not want his wife to work outside the home then he should help pay for her living expenses BUT if she cheats or wants the divorce, then you shouldn't have to pay. But as for the interest - didn't realize there was any for spousal or child support. Get a lawyer who wants to help, not one who wants the money and you may get some results. Sorry to say that in most court cases if you don't have a lawyer you are screwed.

Thanks Blue Jay,For the responce,I even contacted our att. Gen. here in Ohio,And here we go again they said i would have to get a W.Va. lawyer to do anything on this matter.???Like they would try to go against there own state system with our states trying to bring as much funding as possable because of the way things are going here in the USA.
Locked in the system i guess??

For all those who have tried to get child support. I have found out a few important details. First of all, if you have DNA test results and your child's parent receives SS benefits (except for SSI), you do not have to wait for a hearing. If the DNA test results prove there is no doubt that the person is the parent, you can schedule an appointment at SS office and get things started. YOU DO NOT HAVE to have the court order REGARDLESS of what child advocate tells you. Also, I was told that it would be winter of 2008 before a hearing would be held and I started this process over a year ago. After I got the DNA test (even though I knew the father it was required by law) I called the govenor's office and let them have an ear-full of how stupid it was to not be able to make 1 phone call to schedule a hearing. W/I 2 days I had a hearing scheduled. I don't care if you are male or female, the other parent has an obligation to support their child in some way. DO NOT let the government put you on the back burner. SPEAK UP!! I have other issues I will be addressing in a letter to the govenor's office because some of the people I had to deal with were LAZY! No other word for it. Some are great and easy to work with and other's do not want to put forth an effort to help establish support.

I am a 26 year old BLACK male who works everyday for my 2 children on a salary 0f $30000 in the state of WV. I have a college education and I obtained all of this while my father put in 0% effort throughout my life. My father owes me and my sister a total of over $60000 in child support. Unfortunately, he passed away in 2006 and didn't have to pay for anything. My mother tried to pursue garnishment from his Social Security earnings but was told she could not receive any money because he was receiving SSI benefits and the state cannot take out child support from SSI receivers. I have promised myself not to follow in the footsteps of my father when it comes to raising a family. However, the money owed to me would be beneficial to my 2 children @ this present time since the cost of living is now too high for me to do anything extra for my children on my current salary. If anyone knows a way to recovery the child support from a deceased parent please let me know.

I just don't understand why a man doesnt support his child. He's not much of a man. Even if he doesn't want to see it he still needs to take care of his innocent child that done nothing wrong.

NO! The child support amount will only increase if the obligor receives a pay increase worthy of modifiying the child support amount. Also, the obligee has to request a modified child support hearing in order to receive an increased amount of child support. Child support is solely based on the obligor's pay. However, if the obligor's pay is reduced, he/she can request a court hearing to have the child support amount decreased.
