Trespass, destruction of property is a crime, right?

Model Penal Code says the first step in proving trespass, is a determination of 'who' owns the property. Well--nothing to difficult about that -- property owner simply provides their deed. Right! WV Code section 61 says trespass, continual trespass, timbering another's property, cutting fences, bulldozing, strong arming, attacking/injuring elderly property owners, bringing multiple unknown men onto another's property, using violence, intimidation--all crimes according to WV Code Section 61.--So what's up with the Kanawha County Prosecuting Attorney and no charges against the intruders?
