A federal appeals court based in Virginia became the second federal appeals court in the nation to strike down a state’s gay marriage ban, increasing the likelihood that the Supreme Court will take up the issue next year.

But the 2-1 decision from the U.S. Court of Appeals for the 4th Circuit could reverberate outside the Old Dominion before that: The appeals court ruling would set precedent in West Virginia, North Carolina and South Carolina if it goes into effect, which could happen as early as August 18.

The delayed implementation is to allow for the two Virginia circuit clerks who were defending the state’s gay marriage ban to request a stay or to ask the entire Court of Appeals (rather than just three judges) to hear the case. Utah decided to skip the full court and go directly to the Supreme Court after the 10th Circuit struck down the state's gay marriage ban last month, but it’s unclear if same-sex marriage opponents will take the same approach in the Virginia case.

In the 4th Circuit, other gay marriage lawsuits in West Virginia, North Carolina and South Carolina were on hold pending the appeals court ruling, which would now set precedent in those cases. The 4th Circuit decision would also impact Maryland, but gay marriage is already legal there.

While there’s no order mandating that clerks in West Virginia, North Carolina and South Carolina issue marriage licenses immediately (or even if the appeals court ruling goes into effect in August), individual clerks may decide to so based on the ruling. That’s what happened in Colorado following the 10th Circuit decision, and the legal fight over those licenses is playing out among officials in the state.

“The decision itself applied some general principles about the freedom to marry,” Jon Davidson, of the gay rights group Lambda Legal, said Monday in a conference call after the 4th Circuit decision.“Those principles would apply to the other states in the 4th Circuit, but the decision does not order the clerks in those states to allow same-sex couples to marry.”

AG is withholding comment on VA case until final decision. WVa case remains pending so...marriage laws are STILL in effect as enacted by the Legislature. This will NEVER take affect in this state.

She really blew it this time.

A Louisiana woman faces child desertion charges after deputies said she admitted leaving her children unattended in her parked car while she performed oral sex on her boyfriend in his car, according to KBMT.

Police were called to the scene after someone reported the kids, ages 5 and 7, alone in the car around midnight. Calcasieu Parish deputies found Princess Marks, 25, of Lake Charles, in her boyfriend's car nearby.

Marks told deputies that she was unable to see the children or her SUV from her boyfriend’s vehicle. She was arrested and later released on $5,000.

Her children were placed in the care of other family members.

Marks isn't the only woman who has gotten in trouble for flagrantly shirking her responsibilities as a mother this year.

In May, a Kentucky woman was arrested after she allegedly left her kids in a hot car while she went to get a Brazilian wax.

MASON COUNTY, W.Va.(WSAZ)-- The parents of a Mason County boy who died after severe malnutrition appeared Tuesday before a judge.

Preliminary hearings were held for 31-year old Carla Adkins and 25-year-old Jimmie Edwards, each charged with child neglect resulting in the death of their 20-month-old son.

Adkins' hearing was waived, and her bond was dropped to $100,000. If she makes bond, she will be on home confinement and must not be in contact with anyone under 18 years old.

Probable cause was found against Edwards. The case will move on to a grand jury.

Adkins was called to testify against Edwards, but could not because she is part of the investigation, as well.

According to the criminal complaint, Adkins told West Virginia State troopers that Edwards would not allow her to take the baby to doctor visits because he felt the child belonged to her ex-husband. Troopers say Edwards has a 4-year-old daughter who has gone to every wellness visit directed by physicians.

According to the complaint, this all started on March 6 when Adkins and Edwards’ baby died a long, agonizing death due to gross neglect. Doctor Nabila Haikal with the Chief Medical Examiner’s Office says the boy died of anemia.

“Basically heart failure, in the setting of a very severe, profound anemia,” says Doctor Haikal.“Just from putting everything together, it is from poor nutrition and poor intake.”

Haikal said the baby was drinking cow’s milk instead of formula, leaving him so malnourished that he was not able to walk or talk.

Investigators say the parents were buying formula with WIC benefits, but would return it for cash and then spend it on drugs, primarily meth.
