CHARLESTON, W.Va.(WSAZ)-- Kanawha County Prosecutor Mark Plants is facing a misdemeanor domestic battery charge following an investigation into an abuse complaint filed by his ex-wife.

According to a news release, Plants' ex-wife filed the complaint claiming Plants used excessive force while disciplining their child. Earlier this month, a special prosecutor was appointed to the case.

On Monday, Plants was charged with domestic battery. He was later arraigned on the charge in Kanawha County Magistrate Court and released on a $1,000 PR bond.

According to the criminal complaint, Plants' ex-wife told police that Plants caused a significant injury to their son's thigh by whipping him with a belt.

Plants' ex-wife took pictures of the injury after she heard their youngest son asking his brother about it, according to the complaint. The investigator assigned to the case says the injury was dark purple to brown in color and was an approximately six to seven inch "U" shaped bruise on the back of the victim's left thigh.

The victim told police he was staying at his dad's (Plants') house when he shoved his step-brother because he was riding his scooter. That's when he says Plants sent him to his room and later came to the room and held him by his arm and hit him "more than ten times" with a leather belt, according to the complaint.

The complaint also states, Plants took his son and had him stand in front of his step-brother and asked, "Do you think I whipped him enough?"

During the investigation, Plants went to his son's home where he agreed to make a statement.

According to the criminal complaint, Plants admitted during the interview he hit his son with a leather belt. Initially, he told officers he hit him "two times," but later said "maybe three or four times" and it lasted "no more than 20 seconds."

Back in February, Plants told WSAZ.com the abuse allegations weren't true.

"For the past ten years, my ex-wife and I have agreed that spanking on occasion is an appropriate form of discipline," Plants said back in February.

This isn't the first time Plants has been in court since the allegation was made public.

On March 18, Plants was accused of violating a domestic violence petition after police say he made contact with his ex-wife and their two children. Plants was charged with violating it and was later released on bond

Kanawha County Prosecutor Mark Plants, accused in February of bruising his oldest son after whipping him with a belt, was arraigned Monday morning on a domestic battery charge stemming from the disciplinary incident.
Plants turned himself in after West Virginia State Police obtained a warrant for his arrest Monday in Kanawha Magistrate Court.
After being arraigned by Magistrate Tim Halloran, he told reporters who had gathered that he is “not guilty of any criminal conduct,” and would let the justice system run its course.
Allison Plants contacted State Police on Feb. 26 with a complaint alleging her ex-husband caused “significant injury” to their son by whipping him with a belt, according to the complaint. Allison Plants told investigators that she saw a bruise on the her 11-year-old son’s legs after hearing her youngest son ask him about the bruise.
The boy told investigators that he had been staying at his father’s Sherwood Forest home over the weekend and had discovered his scooter missing on that Saturday. He found his stepbrother, the son of Sarah Foster Plants, riding the scooter and shoved him off the toy, according to the complaint.
He returned to his father’s house where he found Plants waiting outside for him. Plants sent the child to his room and entered minutes later with a belt.
The child told investigators that Plants, a former fullback for West Virginia University who is described in court documents as 6-foot-2 and 280 pounds, held him by the arm and struck him more than 10 times with the belt. According to the complaint, Plants then took the boy upstairs to his stepbrother and asked “Do you think I whipped him enough?”
Sgt. M.S. Adams of the Crimes Against Children Unit in Wheeling was assigned to investigate the complaint. Adams photographed a dark purple to brown 6- to 7-inch U-shaped bruise on the back of the 11-year-old’s leg. The bruise, at that point, was allegedly at least four days old.
Mark Plants showed up at Allison Plants’ home while troopers were speaking to the boy. Adams explained the issue to him and the prosecutor agreed to make a statement. Plants told troopers initially that he struck his son twice with a leather belt but later said he struck him “maybe three (3) or four (4) times” and that it lasted “no more than twenty (20) seconds,” the complaint said.
Plants was accompanied to the arraignment Monday by his wife, Foster Plants. He walked through the front door of the Kanawha County Judicial Annex and surrendered himself.
A pickup truck was seen driving around the block near the judicial annex with a sign attached to the side that read “Prosecute Plants.” That sign was seen later hanging from the South Side Bridge.
Inside magistrate court, Halloran told members of the media that no cameras or recording devices would be allowed; however, reporters were allowed into the courtroom without those items.
Plants was released on a $1,000 personal recognizance bond, though it wasn’t spoken aloud in court.
A typical stipulation of bond in such cases is that the suspect has no contact with the victim -- in this case, his son -- however, his attorney argued for that stipulation to be removed in favor of the court order handed down by Cabell Family Judge Patricia Keller earlier this month, which allows Plants supervised visits with his children.
That order also specified that the prosecutor would have to attend counseling. Halloran agreed to Plants’ request.
On Feb. 27, Mark Plants had a press conference to address the domestic battery allegations, against the advice of his attorneys. He told reporters at the start of his statement that he would not take questions.
He said for the last 10 years he and his ex-wife were in agreement that spanking their children on occasion was an appropriate form of discipline.
“I know that some people disagree with that, but both my wife and I agree that it is appropriate at times and we both spank our children,” Plants said.

Plants and former wife Allison have two sons together. Allison Plants is no longer represented by Clifford and has never spoken to the media about the matter.

The Daily Mail previously reported that Allison Plants filed in circuit court to end her marriage to Mark Plants in June 2012, according to a clerk in the Kanawha Circuit Clerk’s Office. The divorce was finalized that November, but never was listed in the newspaper as it was filed under seal, the clerk said.

“I love my children, my children love me,” Mark Plants said Feb. 27.“I’m very involved in all of their sports.

“I am the elected prosecutor, but my number one most important job is to be a father and to raise respectable, law abiding children. If we had more parents who raised their children in a respectable manner, we would likely have less criminals.”

Later that day, Kanawha Family Court Judge Mike Kelly granted a domestic violence protective order against Mark Plants, barring him from having contact with his children or his ex-wife.

Mark Plants was arrested March 18 after Allison Plants told police he violated the terms of the order.

Mark Plants claimed he waited with his children outside a local pharmacy after noticing they were alone in a car in the parking lot at night while Allison Plants was inside.

He was released the same day on a $2,000 personal recognizance bond. At a hearing later that week, Judge Keller ruled that Plants could have supervised visits with his sons, and that the protective order would remain in place until he completes recommended counseling.

Mark Plants, 37, a Republican first elected in 2008, married 31-year-old Sarah Foster on Dec. 27, 2013, in Catlettsburg, Ky., according to a clerk at the Boyd County Clerk’s Office. The wedding was held at Catlettsburg United Methodist Church.

Foster worked for Plants at the prosecutor’s office from 2009 to 2013. In a 2013 office directory, she was listed as “prosecutor’s assistant.”

The February complaint initially was made to Charleston police but officers, with Chief Brent Webster’s discretion, referred Allison Plants to the State Police. Webster cited a potential conflict of interest for the agency.

Sarah Foster is the former wife of Charleston Detective Andrew Foster. Webster said the Criminal Investigations Division would typically investigate allegations of felony child abuse.

the state police are investigating raised welts that are bruises. That is why he got arrested! Did you think he'd get arrested on hear say?
