According to the Kanawha County Prosecutor's Office, two alleged Detroit shooters had their charges dismissed by a magistrate during their preliminary hearing Thursday.

Charges against Carlo Grey and Kenneth Gooden were dismissed by Magistrate Tim Halloran. "It was done before the testimony of the officer was completed. So he didn't make a finding that there was no probable cause. Not sure what [Halloran's] reason was to cut it short," said Dan Holstien with the Prosecutor's Office.

Adam Campbell, also with the Prosecutor's Office, said Thursday, "We disagree with the decision, so we are working with Charleston Police to charge them again and rearrest them [the suspects].

Carlo Gray and Ken Gooden, both of Detroit, were arrested and arraigned last Wednesday evening. They were charged with wanton endangerment in connection with the shooting that occurred Wednesday, April 23.

The victim, identified as Craig Tolley, was shot in the arm and was taken to the hospital with severe injuries. The bullet severed the main artery in his arm.

Detectives with the Charleston Police Department said the suspects were still at the jail, about to be released, but planned on meeting the suspects at the door.

Both were arraigned at the Kanawha County Magistrate Court.

He did the right thing! The prosecutors office failed to subpoena the victim and the witnesses, therefore instead of finding no probable cause therefore losing the case, he dismissed it allowing by law the police to refile their charges and legally arrest them again so that another hearing could take place at a later date. Thanks to due process he could not continue the case since it is a felony and must be heard in a preliminary hearing within ten days of arrest!

The Kanawha County Prosecutors office is who dropped the ball and refuse to acknowledge it. There must be witness an victim testimonies at the preliminary hearing to show probable cause to send the case to the grand jury!

So for the record he did the right thing by dismissing it!!!!!

So the prosecutors office is just dropping the ball left and right these days. This is unacceptable. Plants is on the news acting like he is just completely confused about what Halloran did. But wasn't it Plants' office job to file the subpoenas ???

Plants must resign. People are dying as a result of his ineptness and Judge Bloom took 80 percent of his cases away. Stop the madness. People are literally being murdered

if the prosecutors don't know the law/procedures, the magistrate doesn't know the law/procedures, the cops don't know the law/procedures, then how can any citizen rely on any decisions that any of them make and why are any of these individuals in their current positions. some serious changes need to happen in the kanawha county court system. where are the 'great leaders' in west virginia that has allowed this fiasco to occur? kanawha county judicial system is out of control.

this wasn't a trail. It was a preliminary hearing. An eye witness is not needed. The officer's testimony is allowed. The prosecution only has to show probable cause.
