As I said on the other page. The Deer's are working to get Reed in sent to Switzerland to a Borading school, which we were all wondering what would happen. And I also agree with the other folk's, there will be a Civil Suit, BUT it will never make it to court, as it will get thrown out I am sure. Not like the Deer's don't have the CASH to set up the Morton lady. The single mother, of 2, who will need Help I am sure after all the medical and funeral expenses. SAD and Sorry situation.

The boy is 15. He can't be charged with an adult crime. Doesn't matter what he's charged with. Juveniles are charged by petition with delinquency. The only way a juvenile can be charged with a crime is if he's transferred to adult status. They may be upgrading the charges so he can be charged as an adult. If so, he's in a world of shit because this means the prosecutor is grandstanding for headlines. But involuntary manslaughter is a misdemeanor but it also means his record won't be sealed as a juvenile if he's charged as an adult.The juvenile system is completely different than the adult system.

Also, the parents can't be held liable for more than $5,000 in civil damages for what their child did and they can't be charged with anything either.

The parents, however, can throw money at the mother, ostensibly to compensate her, in exchange for not pressing for criminal charges but that decision is up to the prosecutor since the mother is not the victim. But she has a big say in what will happen.

The parents of the boy who was killed (under circumstances like this) have no way to recover since the parents aren't liable and the insurance coverage is void because the boy didn't have a license.

The mother can hire a lawyer to try and figure a way to get at the parents but there is a law that specifically limits the liability of parents for the negligent and malicious acts of their children. Technically the boy stole the car so the parents are untouchable unless it can be proven they allowed the kid to take the care.

But I'm sure there's some lawyer somewhere up to his elbows in the books, figuring out how to get at he parents and any umbrella coverage they might have or to get at their assets. They won't walk away from this one.

I don't think a delinquency petition based on involuntary manslaughter can be transferred to adult status. I think it has to be murder, arson, sexual assault, robbery with gun or lethal weapon, etc. The difference between involuntary manslaughter and negligent homicide is the latter involves a vehicle. Bottom line, I don't think it would be an upgrade, just a different charge. This information about an upgrade may just be a rumor.

Another rumor is that he was high, from pot. Do you think if that's true, could charges be different? DUI causing injury/death? The DUI statute has language for those under 16.

Mrs. Morton comes from a prominent Charleston family and will be fine financially, I know that for a fact. The loss of her son is a mothers worst nightmare, but as far as finances go, she will be fine.

Prominent Family or NOT. This is just a Prime Example of how MONEY will get you anywhere and then No Where. As for the Morton child, she will always have the Void of the Child she lost do to the Parent's having NO Clue as to where and what their son was doing. I know I would know if my kid's had taken my car without my permission. This is a Prime Example of how Money is not a Good Choice to let your Kid's have free access to that Great cash Flow.
