OK, I know that the workers comp system in our beloved state is majorly screwed and has been for a long time but could these two companies find any more crooked doctors to work for them. Many years ago my cousin who worked in a coal mine got hit by a falling piece of rock and hurt his back and neck and it has changed his way of life forever. The fine people at sedgwick recently decided to end his coverage due to another injury he suffered a few years ago while falling. They said all thats happening to him now is a result of the new injury and i guess the old one just disappeared. And Brickstreet wont give anyone fair coverage for anything. Ive known several people at my construction job that have been hurt for different reasons over the last 10 years get denied for any help after it was the fault of their job. We are going to take it onto supreme court and we wont stop fighting it until the right thing is done. Something in this state needs to be changed. I agree people need to work and there are entirely too many people here that wont, but these companies are hurting people who did work and who provided for thier families. People in our state wonder why we have no business climate compared to all our neighboring states. Look at who controls all this and then you will see something needs to be changed before anyone else or their family has their future decided by a couple crooked dead beat doctors that work for crooked companies.

Absolutely Burton and his close cronies have become millionaires on the backs of injured workers. The financial problems with WC are many - mostly political (Gov Moore lowered premiums for big coal companys over 25 yrs ago - About 10 yrs ago an amnesty program allowed BIG employers to pay pennies on dollars to be considered even. Also employer and claimant attorneys bankrupted the SECOND INJURY LIFE AWARD fund because if a worker got hurt and the small percentage of damage threw him into availability for LIFE AWARD and the other companies where he had the most injuries were bankrupt or something - THEY WOULD JUST agree to let him have it knowing only a teeny amount we be borne by the RECENT EMPLOYER. Also Attorney General had the responsibility for collecting delinquent premiums until the amnesty program set up (and they gave it to WC Legal Division to handle).

It wasn't fraud - nor mismanagement. Though of course some doctors, claimants and WC big shots did cheat some IT'S SMALL compared to what the big shots allowed. Capito should be ashamed of whose daughter she is thats for sure and try to help the claimants who get injured on the job NOW...... to make up for what her father did. McGraw is still in office, he could have allotted monies to WC to stop privitization. Most people don't (or won't) remember what I'm saying here, thats for sure..

The entire system in west virginia needs redone. They need to take a look at Indianas workers comp system. Brickstreet/Sedgwick and a few other companies along with these "hand picked" doctors are ruining good peoples lives. There are entirely too many people in this state that dont deserve workers comp and are getting it, this i do believe. There are also way too many people who need help from a workplace injury that arent getting it. I got the solution: Hire some different doctors and revamp the entire system and let the state government have a stronger oversight on the entire system. Also, there needs to be more drug testing and case follow ups on the people who are abusing the system. This entire scenerio is enough to make a business owner and or worker disgusted. The sad thing is, just about every other state is in the same trouble we are. All politics and who ya know!

In any REVAMP - all directors, CEO's, presidents, lead legal council, etc. WOULD be let go and a fresh start begun - WITH THE MOST KNOWLEDGEABLE WORKERS giving lots of input. As Manchin had only been in office a short while and the bill hit the legislature and PASSED - it's obvious it was all set up long in advance of happening. So of course none of the above can be done til we have a new Governor also !!! Insurance Commission is over Sedgewick, AG unit working with old claims plus they set up a unit for some employers who could abslutely not receive coverage anyplace else and other types of claims are also back with them. And as their commissioner was in on the whole plan - it will be EXTREMELY HARD to get them all back together under a strict supervision of a state agency.

yes some claimants have cheated and some doctors, but that was a drop in the bucket compared to RICH COAL COMPANIES and the ones in charge now who are young and will never have to work the rest of their life as they are now millionaires...Also claimant attorneys hooked up with Brickstreet - they fllow the money of course - so many claimants can't even get knowledgable assistance in getting their due...

Sedgwick is set up to SETTLE or close all old claims so anyway they can do that, they make a percentage of monies they saved the old fund. it's disgusting. The old WC if you had an on the job injury and you fell DUE TO THAT INJURY and made it worse, NO MATTER where you were at - you'd even be entitled to get more percentage - guess now it's a reason to close claims. people are helpless - all the experienced claimant attorneys now work for big companies or Brickstret. Sad - but they are following the big bucks.

Sedgewick is set up solely to get rid of claims that are old. They are under contract with the insurance commission who has control of them - NOT BRICKSTREET - they only handle new claims from a few years ago. But Brickstreet sure brags how t hey deny claims or doctors put them back to work quickly. They are all crooks.

Currently I am being sued by Sedgwick CMS for producing http://sedgwickcms.blogspot.com ( the link in the comment above)and a few other websites as well.

I was able to get the first lawsuit dismissed in federal court here in California, but Sedgwick, ever the relentless has filed an appeal to the 9th Circuit and going for another run at me.

What can you do for me? Post as many of your stories as possible on my webistes, send me emails that tell your story. These things are extremely important because if enough people speak loud enough, someone will finally listen.

Both of these companies are the biggest pushovers in the entire state. They treat people like crap and i used to work for one of them and they treat their employees like trash. This state needs to take action and throw them out asap! CALL OUR OFFICIALS

There will never be a system where all the people who need workers comp get it and those who abuse the system get it taken away. I have personally had run ins with both of these companies over my injurys and they treat you like your a piece of garbage (especially sedgwick). When you have a question about why they decided not to cover a certain medical procedure you finally get to talk to someone and they talk to you like your an idiot. Simply put when you need help they put you down. I have worked hard and provided a very good life for me and my family and when another worker dropped an object and it fell on me and injured my back i dont feel like putting up with all the BS it takes to claim anything with these scheisters. They and brickstreet are both ran by very corrupt people. I have a few conversations recorded between a select employee and myself and im checking into what all repricussions are in store. I invite everyone to take a look at the linked website above and see just how the public of our great country view this company.

I've been battling with Sedgwick CMS/AT&T since I have broken my neck in August. Sedgwick has fabricated "facts" from my doctors, and denied my claim twice. I haven't been paid since January 19, and it was in the amount of $125. My son cannot go back to college, I've sold all my jewelry to pay my electric bill and my 65 year old mother with Lupus has had to get a job to pay my bills. I have tried my State Representative, NC Insurance Commission, Dept. of Labor... none of them can help. They actually told me to get a lawyer, I asked how would I manage to do that, I don't have any money. They couldn't answer that. How can this company get away with this and there is nothing anyone can do about it? I am facing losing my job over this and if I do, I cannot collect unemployment because at this time I am unemployable... I am disabled. How do we fight them?

See what im talking about. These companies need to go. I am so sorry to hear that from the lady above. Its not just a coincidence that so many people in the US hate them. These crooked companies are ruining hard working americans lives and our state governments are doing nothing about it. They are in the doctors pockets and something needs to be done. Hopefully something will happen to a politicians family and then maybe they will take notice. CALL THE ATTORNEY GENERAL! GOOD PEOPLE ARE HAVING THEIR LIVES RIPPED APART BECAUSE OF A TRASH COMPANY! GET THEM OUT!

Alum Creek - absolutely the employers don't stand behind their injured workers at all now. ONE reason is Brickstreet raises premiums OR EVEN drops them if they have several injuries that cost money. Then they are a risk employer and have to pay even more to get someone to insure them. If they are not insured, they are shut down. It is awful - the position they are put in Then burton brags about the millions profit WC - Brickstreet now makes - disgusting. I know doctors that even have big signs up they won't fill out paper work for disability relating to SS - WC - insurance that some workes have at work when disbled, etc. Wow. I dropped the doctor I had when she told me MY HORRIBLE pain with arthritis was just supposed to be and I could still work - I got it later though - the SS disability and made sure I told her about it as I still take my Mom to her and I'll sue her if she don't treat her right though. Good luck to all you workers. It's disgusting to see people that never worked one minute get SSI for disability and ones that work have to suffer and fight for every dime or medical care they get.

I sure am glad that I am not the only one out there. I was just set up with an IME and of coarse the doctor used my family history to say that my injury is all of a sudden better. There is an MRI proving that i have annular tears in two of my disks and both of them are protruding. To top it off I have three other doctors saying that I have to get surgery. I am seriously worried that when all is said and done I will be paralized. My biggest worry is that if that happens what will happen to my kids. All I have to say is thank you Sedgewick and who pays these doctors and how much. If you have any info on Sedgewick that could be helpful please e-mail to [email protected]

I was crushed, nearly killed in a mine accident in 1981, broken ribs, broken back, broken neck and broken shoulder. Logan General Hospital dropped the ball with diagnoses and while I knew my ribs and clavical were broken, the neck and back fractures were not revealed until after much suffering and time I was provided an MRI. I worked another ten years after that accident until the injuries exacerbated to the point I could no longer work. I was awarded a permanent total award in 1996. Last year I was contacted by Sedgwick and told that they were investigating my case because according to their records I had not seen a doctor in years. I told them that I am a veteran and I had been under VA care for years. Sedgwicked said that was unacceptable and I should find a private doctor to care for me.
Per Instructions I found a local doctor, sent in a form to change Doctors. Sedgwicked then promptly scheduled me and IME. I went to the IME in Logan WV. The Doctor spent maybe an hour talking and making a perfunctory examination of range of motion and reflexes. The doctor they sent me to of course found that all my existing problems are age related to natural degeneration of bone and muscle. But since he was one of their "hired guns"
he did what he was paid to do. But I had an opportunity to review the request letter Sedgwick had sent him. There was no way his findings could be anything else. The way the questions were worded
left no latitude for the doctor to find any other way, one of the questions was worded "without consideration of claimant back injury" then go on to ask about certain specific issue. All the questions were worded in a manner that precluded a fair assessment of my conditions related to my disability. Now Sedgwicked has denied my Doctor visits and I am back to the VA, they have no conscience or integrity. Talk about low life. The people who are forced to work for them because of economic times probably lie about where they work, I probably would, I would be ashamed to tell, The state should look into this practice and put a stop to it. The IME is to give a fair independent exam and they are anything but.

I would really like to get in touch for a number of reasons. If you can provide me with any of the documentation that was sent to the IME by Sedgwick or his report that would be great. I will then follow up and file a compalint with the Attorney General in WV. on your behalf.
