few days ago i got a letter in the mail it was from my landlord jill mullins telling us we have 30 days to get out, she had sold the house we r renting, she never told us she was wanting to sell or even thinking of selling, so now my son will not have christmas becouse we have to find money to get a new home to live in by the 30th, she is also demanding we pay her rent, or she will take us to court, she knows we live pay check to pay check and my son has a heart condition, what upsets me the most is that she is taking away from my son by kicking us out on christmas ! i mean really!! i just wanted to put it out here so every one knows what kind of landlord she is and how kind she is to give this gift to us on christmas, thanks jill mullins

Ruin her sale for a while .... The entire eviction can take Up to 90 days. Also google renters rights in WV. She did you wrong so drag that eviction out as long as possible. She won't be able to sale if its not cleared out first. The new owners won't want the hassle of evicting you. Good luck to you and your family.

are you living in the house on a month to month lease? if so then she can evict you on a 30 day notice. however, if you are not then she can not evict you on a 30 day notice unless you have done something that broke the lease. she also has the write to charge you rent for the last month that you are there but has to prorate it if you move out before the 30 days.

If you placed a deposit when you rented the home, as long as you leave it looking the same as you rented it, you will ge that money returned. Take pictures of every room after it is cleaned out to make certain that "things" don't just come up damaged.. May God Bless you and your son, hope it all works out for the best!

good point, i didnt think of that. yes you get the deposit back. the deposit can not be kept for cleaning fees like most landlords try unless it is above normal wear and tear cleaning. all landlords are to shampoo the carpets, sometimes replace the carpet denpending on how old the carpet is, and paint the walls after every tenant moves out. please go to the link i pasted above to make sure you know your rights so the landlord does not try and screw you over.

also, if the new owners decide to let you continue renting the home, they have to honor the lease that is already in place by the current landlord. they can not make any changes to the lease until it expires.

you make a valid point. However, after reading what he or she posted; I have a feeling that no lease was signed or it has expired. A lease not only protects the landlord, but the tenant as well. The actual lease agreement would have to be read. If the lease states that the landlord can give a notice of termation, meaning eviction, for certain things such as,the rent was not paid on the date it was contracted to be, an animal was brought into the home, a bad check was written; The landlord may only be saying the place was sold to avoid a conflict. It is horrible for someone to be evicted during the holidays, however, there may be a legit reason behind the eviction. If there was a lease and it was broken, by the smallest infracture, the landlord has the right to evict. A reason is not necassary, unless it is requested. And the majority of the time, the tennant knows the valiation, but expects the tennant to overlook it. Not saying this is the case, but believe me, MOST PEOPLE FEEL ENTITLED!!

None of it matters, if you live there and have resided there no matter who the owner is old or new you can sit back and force them through the legal process of evicting at least to give you peace of mind through Christmas. With it being the holiday season cases get pushed back. I would start looking for a home but I wouldn't let them pressure you to be out right now. Also if she wont accept your rent payment, keep the amount owed to her in a bank acct to prove funds and intention to pay. If your landlord calls you raising hell then record her but keep your cool. I hope the best for you and your family.
