Incredible.
Horowitz steps down for minor trespassings, the real wrongdoers stay.
Recently Westchester Guardian published an incvestigative report, ordered by the DA DiFiore, about the conviction of a innocent Jeffrey Deskovic, who spent 16 years in jail before being cleared.

One of the main wrongdoers was then Assistant DA Robert Neary, who was appointed Supreme Court Judge 8 months ago by Pataki.
Now Neary enjoys much broader immunity to do wrong from the bench.
Compared to him, Horowitz looks like a vergin.
Here is my open letter to the Editor of The Guardian:

Open letter to Mr. Richard Blassberg, Editor of The Westchester Guardian

CC: NYS Commission on Judicial Conduct
Eliot Spitzer, Governor of the State of New York
Honorable Judith S. Kaye, Chief Judge
Honorable Ann T. Pfau, Chief Administrative Judge
Francis Nicolai, Administrative Judge, 9th Judicial District

Dear Mr. Blassberg,
I'm writing to you in regards to the article "Blue Ribbon Panel Delivers White Papers DA Asked For" from the July 12 issue of The Guardian.
In your article you revealed the name of the former Assistant DA Robert Neary among the four main wrongdoers in the conviction and imprisonment of innocent Jeffrey Descovic.
In your article you correctly stated that at present Mr. Robert Neary acts as an appointed NYS Supreme Court Judge.
I believe that you are aware that Mr. Robert Neary run three times unsuccessfully in elections for Westchester County and NYS Supreme Court Judge and was recently appointed as a Supreme Court Judge by governor Pataki
What strikes me is the fact that you stopped here.

I have a couple of questions to you:
1. Do you feel comfortable that one of the guys who took away 17 years from the life of young Jeffrey. Descovic (and most probably contributed to the murder of Pat Morrison) now operates with almost full immunity under the guise of a Supreme Court Judge?
2. Do you think that having Mr. Neary on the judicial bench does not represent an imminent danger to the life and property of Westchester County residents?
3. Do we need to wait until the wrongdoer does a major strike (of the magnitude of wrongful conviction of Mr. Descovic or the murder of Pat Morrison) in order to take measures to prevent him from doing wrong.
4. What do you think is the role of journalism and in particular of The Guardian - keeping it cold blooded and report the events post factum (just like the investigative panel appointed by the Westchester DA) or taking a proactive role in uprooting the public corruption and helping the society.
Curious to know your stance.

My personal believe is that Mr. Neary needs to be suspended immediately from his position. Of course he might challenge the investigative panelís report and if he proves that he didnít do anything wrong he can be reappointed to the Supreme Court.

I'm sure you can do better.
Thank you in advance for your response,
Peter Petrov

If Judith Kaye is involved or you are making a plea to her, it is a waste of time. I say New York should have Gotti in charge, perhaps that way we would not need justice in New York at all, as it appears that injustice rules and NY will soon be coined the Rotten Apple. Good and decent lawyers need to get a backbone and take on these corrupt few attorneys who have siezed the key posts and take back their profession which used to be about integrity and honesty, not how much is in it for me.
I think these rotten politicians need to have 10* the time given for crimes against the public to set new examples to those perverting it. Come on New York, get a grip on crime, these guys are not good for crime or justice, they make the state a joke and ruin the New Yorkers claim to being straight up folks.
