Proof that not all motorcylce accidents are caused by 'idiots' in cars. There are plenty of idiots on bikes too. Heck for that matter there are an equal percentage of idiots any where you go.

No helmet. No helmet. Do insurance companies pay death benefits when the rider failed to take reasonable precaution to protect himself? Yes, I know the PA law does not require a helmet be worn, but that has no bearing on what the insurance company does.

You are absoulutely right. The insurance should be voided when not wearing a helmet just like the seat beats.

Am I understanding this right? Insurance companies won't pay death benefits if seat belts were not used?

It's the law. They don't have to wear them, thus the insurance company has no option but to cover them. I saw a local cop leaving work on his bike with NO helmet. His choice, but not a good example.

If I am not mistaken about insurance, this will go under his home owners, not his car insurance. I don't believe there is such thing as motorcycle insurance???

to fatboy: I apologized for any wrong info. I just found this on Pa motorcycle insurance.

GENERAL MOTORCYCLE INSURANCE COVERAGE OPTIONS

The following coverage is included on all standard policies:

Underinsured/Uninsured Motorist Coverage
All policies include at no additional cost uninsured/ underinsured motorist coverage. The limits are set at the liability limits that you choose for your policy. This coverage allows you to obtain payment for injuries by an uninsured or underinsured motorist who is at fault in an accident.

Guest Passenger Liability
All policies include at no additional cost guest passenger liability insurance. The limits of coverage for your passenger are the same as your bodily injury liability limits.

Medical Payment Coverage
Your policy of insurance provides Medical Payment Coverage according to the laws of Pennsylvania. Medical Payment Coverages apply only to pedestrians when struck by your motorcycle. Medical Payment Coverages pay the cost of treatment up to $5,000 for the pedestrian from hospitals, doctors, and other medical providers. Medical Payment Coverage is not provided for vehicle, operator, or passenger.

I feel bad because someone was severely hurt. Now the manner that he got hurt was just asinine. Bikes are fun but use your head...for thinking not crashing into barriers.

to all of you that are wondering about motorcycle ins ...it covers the bike, other person and your passenger but NOT you that falls under your medical ins from where you work or quite possibly your homeowners but more likely than not your car ins will not cover it.
yes i am a biker myself and yes i do wear my helmet but that is my choice to do so.

I think it is a big surprise that noone is blaming the truck driver, since it always seems to be our fault any other time there is an accident. At least that is the way it is projected through comments and other media, almost all accidents are do to something the truck driver did/didnt do.
