i am truly sorry for the ones that feel they didnt get enough money,actually we all didnt get enough for our suffering,although some injuries were worse than others. my lawyers say they are sending out the checks march 1st 2012

Thanks Sue for the input. I'm hoping you are correct. These checks should have been here by January and it is really sad that for many they never lived to benefit from it. Last week my lawyer told me two weeks but they also said that a month and a half ago. Please keep updated of you actually receive it. I know they are also doung what they can but its unfair to the claimants to keep the money in their account and let it accrue interest. I pray you are being told the truth about the 1st..I know a lot of people will be relieved a little.

I hope we get something soon am on the same boat I was told before christmas then begining of february and now they told me last week that they have until may to pay that money , am very desspointed !!!

i hope i am right too,i also was sent a letter telling me the same information that my lawyer told me, i will probably call them monday to see if there is any change and i will let you all know, i hope i get the same answer,i hope soon this will be over for all of us

My lawyer called. Was told that the funds will be realeased within 10 days then a check sent a few days later. Still puzzles me as to who is holding the funds and drawing interest that should be paid to the claimants. Getting confused as to why we are all being told something different. Also, does anyone know how they will be sending the checks? Certified checks so that they can be available to us immediately? They definitely should be overnighted to everyone as long as they have made us wait.

Well question to everyone that is chatting here. Have you heard when you were going to receive your money for the settlement. I was on one other website and those folks have recevied their money and I have not. I called my lawyer after I posted the last message and he told me that it will take at least 45 days to receive it, making sure all paperwork is up to par. I asked him why and he stated that they wanted all waivers in. I called him again today asking him about some of the messages I read and now he is telling me I will receive my check on about the 15th of March. Now that is not 45 days to my math. Now I am trying to find out who all has really receive anything yet or is in the Kansas City area that have heard anything from their lawyer. I think someone is getting richer off us, if they have banked the money and are waiting to pay it out to us.

I agree, Bob and am hoping that with enough inquiries wanting to know where the funds are being held that maybe we will see that date kept. It is completely unfair that whoever is holding it is drawing interest on it while those in true need of it go without. I am trying to keep faith in my lawyer that this promise will be kept of two weeks. I will continue to call once or twice a week until I finally do get an answer that is definite. The most claimants can do is keep calling and inquiring until maybe we all do get the right answer. What is the site that you were on that said others rec'd funds? I had been told that some of the small claims had been paid to those without any major problems. I'm unsure how those amounts could be paid since the settlement was made as a lump sum settlement? That's the only part that is really bothering me.

Alicia, I think you have every right to call your attorney whenever you feel you need to. After all they are getting more than 40% of your settlement! They work for you!

I know it isn't a simple process but all paperwork has been in since January that they needed. If the paperwork has been confirmed signed at the amount that Bard and Davol agreed to pay... then why would there be a comprehensive problem in getting it paid? I understand paperwork isn't is quite tedious in fact but the settlement has been decided on for is disheartening. My lawyer still insists it will only be a couple more weeks, so I am hoping that they have been forthright with this information. They have been more than willing to answer questions and not once have they made me feel like they were angry or upset I was calling. I don't know who your lawyer is, Alicia... but that is wrong. I would voice your opinion to them that they are making you feel that way and that you chose them with confidence that they would be there to answer any questions for you. I'm going to try to have faith that they are giving me accurate information not only just for my sake, but for everyone hurting and ready to put all of this behind them legally and emotionally. I will keep updating on my end.

From everything I have read Bard and Davol agreed to pay 184 million dollars in July 2011. But according to my attorney, they haven't paid it yet. I don't understand how they can hold onto the money this long. Don't you know if you agreed to pay them, they wouldn't be patiently waiting for you to get a little more interest on that money before you paid them. They would have you back in court in no time.

According to my lawyer, some has already been paid out. Which again, confuses me. I just wish they would do the right thing and get us all taken care of. I am calling again next week and am continuing to do so until the checks are printed and sent. I have a right to know everything going on...and it is my lawyers job to keep me informed and answer questions I have. They are stating they expect Bard to give them the funds next week. Let's all hope so.
