There is no telling how much a settlement will be, if there will be any. We will need to closely follow updates to know how much compensation may be awarded to complainants in any case a trial is concluded with a plaintiff verdict. I am keeping my fingers crossed for those people who have had a first-hand experience of these devices' side effects. I sent a certified ,notorized letter of rejection in may 2012. Was offered 30.000.00. But weighing the overall expense if i would have agreed.. I would have owed millions and lost my medicare and medicaid benifits.( which i was promised from the very beginning i would never loose it.)
Well its been.. How many months since then? Its been more months of pure stress ,pain, poverty and days on end of tears of uncertainty. Williams kherker. Motley rice will not submit information to medicare. Medicaid and all affiliated organization thats envolved in this case. I am being turned down for extensive and most needed operations. Spinal nerve blocking shots. Prescriptions all due for the fact my attys will release legal documintation that i refused and denied the offer.
This unjustly inhumane neglegence from my so called attys whom i put my life my hope my dreams into their hands. My life is worse off now from their neglgence then the horrific pain i sufford during the years after mesh was removed.
Theyve completely taken my benifits my welfare my independance my integrety and all hopes of ant future from me.
There still sending me the same contract for the settlement. Even after all these months of my rejection.
I spoke on the phone with a witness to my attys and begged them to just please give me back my medicare benifits. Without a letter from them i will not be able to have any health care paidfor.
This is a evil inhumane selfish group of so called representative that has made millions off of us and those who will be forever efected by and will never have a chance for a productive life.
Shame on them all! Be very aware that its really never over. Either by continueing findings of more damage this mesh has caused. And dont expect them to go lightly if you reject their offer. They will continue to destroy any bit of life you have left.
This has totally ruened my life.
My God help us all and forgive their heartless souls that has impacted my life to nothing.

I had not communicated with my atty. in St. Louis since Sept. so I sent another email of inquiry. He told me he had discussed my case the prior week with the defense attorneys and they had not yet reviewed my case. As soon as they do his email state he will then make his demand and he would let me know. His email to me was on Jan. 17 and so far I have not heard a thing. It is (4) years in Feb. when I first filed my claim. If and when I hear more I will let others know.

Finally received a settlement two weeks ago. The lawyers picked it clear to the bone; left enough for me to get my TV and internet up and running again. And purchase items like A1 steak sauce, honey, spice's: the stuff you can't buy living on SSDI. Was I compensated? No. What I was was surprised I received anything at all. What I did achieve was a successful meshectomy last March. I still have chronic pain but I don't look pregnant anymore and I'm enjoying life again. Good luck to those of you still waiting.

I am glad you are getting better, i have been in your shoes also. Adhesions are my biggest problem, you have been years waiting for a decision on your settlement,what category were you in. The law firms and courts got their share, not much left for victims. Best of luck going forward.

Adhesions remain my problem. All synthetic mesh was removed,(as I wrote on the other forum.) I was class 5A. I answered an add in my small rural TX paper for "mesh victims", from a law firm up in MN that handled class action/MDL suits. If I was that firms only respondent they more than paid for that add after they took their share. The "system" was set up by the powerful for the powerful, the best we can do is file our Maude reports with the FDA--and if you think those Maude reports don't do anything think again. And if you have SSDI/medicare NOT SSI/medicade, you're benfits will not be affected. Do not freak out over some of the tales on the internet. I'm sure some of the regulars will attack me--oh well, I've suffered my share and lost it all. So the little I gained back for 30 min. worth of paperwork, hey like I said--I restocked my pantry, bought new eye glasses and have a little set aside for life's sour lumps.

Thank you for being honest, all of these cases got dismissed in the Canada class action because they are working with Motley Rice and Motley Rice said they could not prove these meshs caused injury. LOL. Love to know who the law firm is in MN. Drop me a hint some time on another site. We all suffered a lot of pain for a simple operation that we all found out to late, that the hernia could of been repaired without mesh.

Everyone needs to know that class actions only make attorneys rich while victims continue to suffer. You must get separate lawyers and stop jumping on the class-action lawsuit band-wagon. An example of a class-action debacle was one that was levied against Royal Caribbean Cruise-lines. The settlement resulted in "$250 cruise coupons" awarded to the plaintiffs (as if any plaintiff would ever want to use their "award") while the attorneys made $20 million. When the plaintiffs protested and wanted the attorneys paid in cruise coupons - the judge found in the attorneys' favor (of course)! Class action lawsuits should be illegal!!!! I'm glad to see someone recommend Motley Rice as they are working with my attorneys from New Jersey - Cohen, Placitella & Roth - who are not doing my case as a class action but separately (and I think that's the way they are planning to handle all their mesh cases but I'm not positive). In addition, the contingency rates drop in New Jersey the more money that is settled so the victim gets more and more and the attorneys accept less and less. I would NEVER use another attorney from Nevada (they are all crooked and settle behind your back just so they can move on to the next case).

I read more and more horrible things and while we settle with the class action we felt we didn't have a choice..it was worded that all the trials were being moved there for one settlement so I think for most of us..we truly thought we did not have a choice and weren't told clearly we did! We received our first part of our settlement last April while they held 10 percent telling us that should be settled within 6 weeks. Here it is almost a year later and STILL more runarounds! Told a couple months ago the 2nd check would be given to us by end of January. still nothing and all we get is "no change". I was very patient and tried to understand legal process takes awhile but this has gone beyond ridiculous and past insane. I'm truly sorry for all of you who suffer. This is a nightmare for all of us and I for one just want it over with :(

A New Jersey jury has awarded $3.35 million in damages for complications caused by vaginal mesh sold by Johnson & Johnsonís Ethicon division, and the manufacturer may be forced to pay additional punitive damages for willful and wanton behavior in failing to warn about the risks associated with their Gynecare Prolift mesh.
The verdict comes following a month-long trial and is one of several thousand vaginal mesh lawsuits pending throughout the country against Johnson & Johnson and manufacturers of other similar products that are used for transvaginal repair of pelvic organ prolapse and female stress urinary incontinence.
The complaint was filed by Linda Gross, who alleged that she suffered severe and debilitating injuries after receiving Ethiconís Gynecare Prolift mesh in July 2006.
As a result of complications associated with the mesh, Gross required at least 18 surgeries and alleged that this could have been avoided if the manufacturer had adequately warned consumers and the medical community about the potential risk of the mesh eroding through the vagina and causing other health problems.
The jury awarded a total of $3.345 million in compensatory damages, including $1.385 million for past and future medical treatment,$680,000 for past and future lost wages,$1.1 million for pain and suffering, and $180,000 for her husbandís loss of consortium.
After reviewing the evidence presented and the ruling, Judge Carol Higbee, who is presiding over this case and hundreds of similar lawsuits pending in the New Jersey state court system, decided that the Grossís lawyers will be permitted to ask the jury to award additional damages designed to punish Johnson & Johnson and their Ethicon unit. The jury could award up to $16.75 million in punitive damages under New Jersey law.
Vaginal Mesh Litigation Pending Nationwide
The case was the first Ethicon Gynecare mesh lawsuit to reach a jury in the United States, with Johnson & Johnson facing more than 3,000 claims in state and federal courts throughout the country by women who suffered similar injuries.
In New Jersey state court, Johnson & Johnson faces at least another 1,800 lawsuits that have been centralized before Judge Higbee for pretrial proceedings. In addition, another 2,000 complaints filed in U.S. District Courts throughout the country have been consolidated in the federal court system as part of an MDL, or multidistrict litigation, which is centralized before U.S. District Judge Joseph R. Goodwin in the SOuthern District of West Virginia.
Judge Goodwin is also presiding over the consolidated pre-trial proceedings in four other vaginal mesh MDLs, each involving similar transvaginal mesh products manufactured by different companies, including C.R. Bard, American Medical Systems (AMS), Boston Scientific and Coloplast Corp.
Well over 10,000 total lawsuits over vaginal mesh are currently pending throughout the U.S. court system. All of the complaints involve similar allegations that the transvaginal mesh implanted to provide support for the bladder or other pelvic organs caused women to suffer severe infections, erosion and other complications. Plaintiffs claim use of vaginal mesh for treatment of pelvic organ prolapse or female stress urinary incontinence is dangerous and that the products are defectively designed and manufactured.

after going five years pursuing representation I finally had my claim filed last month. I kept hearing all this statue of limitation mumbo jumbo from east coast law firms .A west coast law firm revealed that if my patch was recalled and the operations transpired prior to 2007 then I could file. Guess what? The east coast law firm only after me sharing the info I got from the west coast gave my info to some firm that bundled it with others. After viewing these posts I must be looking for a miracle. Bard only put 184 million out there for about 4500 claims. We all need to pray. My lawyer said I may not get a dime. So what's the use.

Good for you, you did not give up, in 2007 a lot of the meshs got into the so called MDL that were not in the first recall, 2005. I posted the payouts. Some cases have been dropped after six years of waiting, after the March 7 meeting, if you did not get a letter from your law firm count your blessings. Your lawyer is right, but it will be negotiated and lets hope you get something, the law firms are just collecting easy money becausce the mesh has never been proven defective, all the cases including the new cases have been won on technicalities. Do you know which category you are in, or the type of mesh, not long ago i got a person a Law firm and her payout will be 185k. The courts, Law firm and your health insurance get their cut first. Mike, they want this case over, some law firms are dropping unsettled cases, they will not fight for mesh victims, they are taking the easy money made of the ring breaks. As i said before the mesh has not been proven to be defective and that means a lot of cases will be dropped and if you got in on the first payouts count you blessings.
