Now I am wondering when the money that went into the trust to cover those that have the same problems as the majority of us did. When is that money going to be handed out, only after it sits and collects intrest or pay the meals and hotels for the any lawyer that is now jumping on the band wagon. I settled mine case and got shit, but then the other day I got a phone call from an lawyer who wanted to handle my case. I explained that I had one and he thanked me and hung up, I called back and it turned out that he had a list of patients and to see if anyone wanted to file suit. That is sad.

How long does it take for comments to be posted - I commented a week ago and it is still not posted. Don't want to repeat it all over again - just that what has happened to all of us is inhuman and criminal. We have had our lives taken from us - our families lives have been changed forever - we have suffered a great deal of pain and have been left disfigured and useless - I honestly hope that the principals involved with Davol/Bard and the FDA someday suffer what we have suffered because they did not do their due diligence. They should all be charged criminally.

Lorene - after searching for 2 years for a web site that would actually give me some answers I finally found this one last week - I found your comment interesting - regarding your cancer I too was diagnoised with cancer about 6 months after my emergency surgery to remove the Kugel mesh - I have always believed the kugel mesh caused my cancer as it is in my blood, bone marrow and lymph nodes -non curable - but none of my doctors agree with me. Do you believe or have you been told that your cancer is connected to the Kugel mesh? I also have had 2 abdominal wall abcesses, a total hip replacement on the same side where the mesh had migrated to and was wrapped around my pelvis and leg and my abdominal wall tissue is gone! I am a 67 year old woman who looks like I am 9 months pregnant on the right side! I've told my daughter to sue everyone she can after I die - I made a major mistake when I hired a lawfirm that I knew nothing about just because they were handling other Kugel mesh victims - I should have hired a REAL personal injury attorney who cared about me more than "a quick easy buck"!

Well, my attorney told me he expected a settlement offer by end of summer, well now he tells me there is still no offer. It has been 4 years. I have been through (4) abdominal surgeries and have more pains now than ever in my life. I am getting allot of unexplained pains in other areas and I think it is coming from the last surgery. Yes, we are the ones suffering and my attorney is doing very little to help. He just keeps telling me to be patient. My life has forever been changed by these surgeries and who knows what I will be faced with next. I try not to say much around friends and family. They just don't understand. They think if I am walking upright and functioning then I must be WELL. I sympathize with anyone who has had to endure this mess. They are probably hoping I will die and they won't have to pay me a settlement!

Thanks, time is a great healer and after all the surgerys we went through, we are lucky to be alive. I think about how the health system and legal system failed us but we must move on and just warn others, who might fall into the same trap. Ten years since my implant but i was lucky i had a safety net in place. Keep up your posts to remind others how life can change from having a simple twenty minute mesh implant operation.

Well, I finally got pymt today. They took the % as we had agreed, but also took another 4% they claim was mandated by the court to be placed in a 'common fund'. Does anyone understand what the 'common fund' is about? I had months of runaround. Bob in KC if you're still on this blog, I think we have the same attorney judging from one of your posts. They claim to have been holding up my money due to Medicare and I said even though I'm old enough for Medicare, I don't have it as I still have health insurance through my employer. I also had a letter from Garretson and I phoned them several times to see what the hold up was, and they never returned my calls. Yesterday, I finally had a conversation with my attorney who started yelling at me, saying he was just going to 'cut my check as he was tired of discussing this with me'. This was the first time I had spoken to him since this all started about 5 years ago. He kept saying Medicare has a $750. lien on my money and I said that couldn't be. He told me to call Medicare, so today I called them and they said, NO YOU DON'T have any liens or claims with us. I don't know if someone has stolen my SSN or if my lawyer is confusing me with someone else. Very frustrating. Anyway, when I got my mail today, here's the check minus another 4%. If anyone can explain that, I'll cash it and be done. I was told all along there was a set fee and that would be the max, but now I'm told the court has ordered the add'l 4%. I'm just sick and want to be done with all this. Thanks for anyone's help.

We might have the same lawyers, I just happened to get on to see how many others are still being screwed. The 4% is to be used for those that want to join the law suit at the last and can't prove they have a claim, but will collect some money from us, sorta like welfare. Go figure. We are to get that money back to us, if it is not all used up. But you know they will do that. As far as Medicare, that mess was settle a while back, the claims would have been sent to those involved and to the lawyers, if you stated that you are on medicare or medicade. That this is the only way they knew that you were involved. But I think they thought that if you were a certain age, then you must have had medicare, so there for you owe them back. Remember all, the more time your lawyers have the moeny in their account, the more intrest they get to keep off it. I figured for what I got from my lawyer, is that he had 52 clients in KC that he was working with and if he go approximately 20,000 per person then he made over 1,000,000 + his payment for going to help figure out this is Rhode Island, which was paid out of the settlement, so he cleared for his firm over a million dollars and got to spend time in Rhode Island and to be flown home first class on the weekends to visit the family, while some of us sat at home wondering which bills to pay first with our money when we got it. So yea I am a little bitter over this mesh and I am still paying for it now with constant health issues. Oh by the way, Devol stock went up over 4 points on the stock market after the settlement, making up the money they lost to us. Go figure. For those who haven't gotten paid yet and your lawyers are not talking to you, then to to the Rhode Islands website and find the name of the lead lawyer and call him. I did, that is how I got paid. Thanks for your answer Bob. I will now cash the check and expect nothing more. I forgot to mention, I did ask about the 'interest' on the monies they've been holding for so long, and was told that it went to the 'administrators', but my attorney never explained WHO the administrators really are. He just said it was such 'a small amount' to which I replied, well $5. is $5., but of course he didn't budge on that. I was on the low end of the payment because the problem I had early on, actually corrected itself (at least thus far), so they didn't pursue my complaints since by the time we were actually filing papers, I was no longer having pain. I had pain for almost 3 months immediately following surgery and missed a lot of work because I was a bit fuzzy taking the pain meds. My surgeon yelled at me stating 'is it bad enough to go back in?" I was so stunned that I sheepishly said 'I guess not'. When all that happened, I didn't even realize there was a problem with the mesh. One day, quite miraculously, I was in my son's swimming pool and I laid over a big rubber ball and something snapped and the pain was gone. I have a nice stretch mark and saggy stomach, but I guess if that's the worst I'll feel lucky. I have been afraid to work-out, lift, etc. as I don't want another surgery. Well, too much info, so I'll sign off. Thanks again and good luck to all involved in this mess.

Had mesh implanted 12/2002 and bowel obstruction 2011 (had to cut out part of small bowel to remove mesh and spent week in hospital--7 1/2" incision).
Wrote letter to Don Magliori on 9/25 about case but never received answer. Just emailed law firm from website. Any ideas on other lawyers (live in Twin Cities, MN)

Cindy do you have your lot# and manufacturer of the mesh. The same happened to me ,implanted 2002, removed, bowel resection 2003. Will never see a cent but i can tell you if your in or out of the law suit. Motley Rice is only doing ring break cases. Mine was Bard Composix Mesh, sold by Bard/ Davol and no longer on the market. Some have settled and the rest are still in the MDL.

Thanks for your response. I have the surgeon's records but no lot number; from report: "A 12 mm round Bard Kugel Composix patch was placed intraperitoneally behind the fascia, and then it goes on to say how it was sutured. The surgeon did call me and say it was recalled around 2007 or 2008 (I will have to check the records), but upon questioning him, he said he really sutured it well. Who is doing the buckling cases? I saw this posted by you on August 13:
