"It's not simply about damages, it's about accountability and it's about ensuring that a very, very flawed system can be fixed," said Fidelma Fitzpatrick, a lawyer representing Ng's family.
How about the immigrant holds his/herself accountable? How about obeying the laws of this country by not overstaying your visa? Remember, a problem always has a begining, and violating visa laws was the 1st. And it's not a flawed system, it's only a flawed system when it doesn't work in the immigrants favor.

All your ranting is irrelevant.

The Chinese immigrant was subject to the jurisdiction of the USA and therefore subject to the Constitution and Federal law which guarantees that a person may recover money damages for loss of property, personal injury or death where damages occurred as a result of the "negligent or wrongful act or omission of any employee of the Government while acting within the scope of his office or employment, under circumstances where the United States, if a private person, would be liable to the claimant in accordance with the law of the place where the act or omission occurred."

I hope this Chinese family received just compensation @ taxpayers expense over this horrible ordeal.
