Again when you can separate out the 2,000 or so homes that are not in the original 10 sections of Mastic Beach then you might be able to get somewhere with the lawsuit. Only the lot owners in the original ten sections are covered in the deed. How do you separate out the rest?
Funny thing, I read the deed and there is no mention of the original 10 sections. It just says if Mastic Beach becomes a village.....but why quibble over a few words.

yea, let the judge do that.
But if YOU don't think it matters, then lets give the village everything. I mean, look at the roads and storm drains, I'm sure the village would do just as wonderful a job with the marinas as a they are with them.

Your amazing. It's a good thing you didn't oppose the village. We would still be part of the town if you had.
As soon as the judge hears about your legal argument, the case will be thrown out. You should make sure the mbpoa lawyer has this information, asap.
It's a good thing the mbpoa never expanded their membership outside their original ten sections.
I don't know who you are, but you go girl. You're spot on with your legal thinking.
No worries the case will probably drag out for another couple years. How many more lawyers will the village leaders fire and hire in that amount of time? another 2? 3? How much will this cost the taxpayers? And for what exactly? I notice not one of you can say what the village has planned for the properties. Why so quiet on that subject?

I can't tell RIGHT from WRONG...I know the MBPOA is the only issue you have, so keep attacking the village. It has already been proven part of section 1 is on village property. I believe that should monkey up the works for you. Let the court decide the issue, but secretly, I heard there are settlement talks already underway. I hope this s true.

The last lawyer was simply incompetent he was pushed on the village by the convicted criminal who is now advising the MBPOA - By the way, there are in multiple lawsuits with several residents in our village who have been forbidden to use the clubs marinas - so please do not push the lies to try and make this association sweet and harmless they are A PRIVATE CLUB they have stated that in court papers and they want control. The reason the village is forced to spend tax dollars is because the association refused to honor the deed and has stolen the marinas from the people of Mastic Beach. The Village should have simply taken possession of the Marinas, as outlined in the duly filed deeds -and had the association sue the village - they would be bankrupt by now. Your tax dollars, if you actually pay tax are being spent to protect the residents interest not line the pockets of a private club and their convicted felon advisor.
the original lawyer was hired more than a year before sspress guy was even involved. if you recall the very first thing that the village did was sue the mbpoa. they did not even wait a week. so sspress guy was not involved at all. they picked their own attorney.

The difference is that Paul hired him and when his contract was up the board did not renew it. Not to mention the MBPOA complained loudly and often that the Village had hired a convicted felon.

I never approved the contract (he was not an employee), for Fred to do PR work. I was glad when they did nt renew it. Fred was so pissed, he offered Carol all his help to try to stick it to the village for not paying him. It's all about the money.

I also disapprove of te village using the SSP as a newspaper since Fred runs the show, he is likely the editor but he refuses to put his name on the byline.

the MBPOA did no such thing. If people said it, and they happened to be MBPOA members, so be it. But the MBPOA did NOT make any statements that you claim. Show me in writing where the POA said that.

the original 10 Sections of Mastic Beach Proper.... Is this really the defense to the lawsuit? You allow full membership to any Mastic Beach resident....even renters. I doubt the judge will entertain this argument.

i am not a lawyer. i don't know what the lawyers are doing. who cares what anyone's "defense" is who is not the lawyer directly involved in the case. the rest is all people with too much time on their hands and no real clue at all.

go ask the judge. For someone who doesn't care if the village gets the marinas, you sure talk about them a lot.
Good luck with your lawsuit, you'll need it.

You said part of MASTIC was included in the boundaries of MBV......well, give me one address, or admit you were wrong.

Who cares?. You aren't the judge so you don't matter.
Show me once instance where the MBVEC "intensions were pure and honest" or admit it was the stupidest thing you have ever said in your life. Because it was.
