Why would any one purchase water rights in any quantity with out having a clear record as to the condition of the water they are purchasing? If there was no mention of this as a condition of the sale is it buyer be ware? A purchase of this size should have had a certification of the suitability of the water for drinking purposes. The testing should have been done prior to the signing of the paper work. This works much like a home inspection or title insurance. The County is trying to protect water contamination by increasing the Deming Ranchettes lot sizes, but they purchase water rights with out documentation of the waters safety for drinking.

Irwin owns a lot more than 600 acreas of water rights when this farm was sold. She sold only the water that wasnt worth a cr*p. There was a reason why she and her boy sold only THOSE 600 acres... SEPCIFICALLY those 600... Does anyone else wonder why she sold those 600? Or are you all still smokin' too many free lolipops you got from the lill' ol' gray haired lady at the bank when you were 12 has your brain cloudy?...

I'm not sure if it's usually done this way,or if I'm even reading this right, but wouldn't one test the water FIRST before any contracts are drawn up and signed ? The way I read it these dealings went on in 2007, both tests done in 2008, then the trouble started.
Dona Irwin stated they did this in "good faith", but it would make her and her son look better, knowing now the water's tainted, to walk away from the deal and forget about it. Hope they find a loop hole or something in order to rescind this.

I'd say the Irwins sold those 600 because that was the only 600 acres that they owned that wasn't farmable anymore or the crop production was so poor they couldn't make a living off it if the Irwins farmed it...and I'd say the reason for the poor producing was because... Somehow I dont think that feeding arsnic tainted feed to livestock is going to have a positive impact on the end consumer either... like people? Think outside the box... And as far as how much land Donna and Son own... Just go to the county assesors office... When a buyer goes into a purchase, it is their job to do all the tests. I would think if the county was going to buy this property specifically for the water, that they would taken the time to make sure the water was Suitable. If these precautions had been taken, then the county could have found the problem before now, and there would be no issue. It seems to me that it was the county's lack of thought that caused this problem.

Wrong. Did you know that if you sell you house and say the roof doesn't leak, and then when it sells, you the buyer can be held legally responsible? It was also the seller's responsibility to know what they were selling. Did the hag know? I don't know that. This is a response from a long time, educated farmer…from what was said above from one of the comments about the Irwin farm and the land in question: Most farms in Luna County have out ground which is land that is left out on a rotation crop basis. Mr. Irwin, for many years, did not farm that section of land due to the land not being level and the water seems to be in question which would lead to bad crops which would not make money. The land lost its water rights and that is why it seems the airplane was seeding that section of the farm to try to trick the State Engineers office by saying the land is being farmed and the water rights should be transferred back to the area. The fields had no way of being watered because the land was unlevel and it sounds like there was no irrigation system. Chairman Diaz was stated that he had checked the wells while in the capacity as a Commissioner knew and tried to help with the misuse of County funds and it seems that is why he keeps abstaining yes or no on this issue.
