Does Georgia have a "Sunshine Law" (an open meetings act requiring prior media and public notification of a Public School Board meeting? If so and a meeting was held without proper notice of time, place, and agenda, then this action would be a flamboyant disregard of the right of the citizens to be present and understand the meeting. Is Rome where the meeting in question was held? Is Rome in Bartow County? Does Georgia law allow Public School Boards to conduct meetings outside of their county of jurisdiction? Does this viiolate Georgia Law?

I may be confused is Berry College where the questionable Board meeting was held? Is that in Bartow county? I maight have gotten confused on the Rome, Georgia question. The main question is what public notice must be given for an out of town meeting? Most states require a 48 hour public notice in the local media if out of county meetings are allowed! A number of states do not allow out of county meetings if a vote is taken, ie allow meetings for information only with no decisions being made. What about Bartow County Georgia? What is the law?

ECA is in dire financial straits and the enrollment has declined considerably. They can't even afford to repair their own gym.

I had heard that as well. Maybe they hired Davis thinking he would stimulate the enrollment, which he has not. . .

Dr. Nelson's statement last night on the board appointment had so many flaws in it that we had to issue a response.


The board just can't bring itself to admit it made a mistake. Tonight, Ms. Sullivan said that the laws were "in conflict" (they aren't...the state law points us directly to the local law in the very first clause) and that the local law didn't specifically prohibit a temporary appointment. How convenient...it doesn't say we can't, so you can't stop us...

The biggest problem is that they voted to have her finish the term. Even if they were allowed to appoint temporarily,(which they aren't) the fact is that they did not vote it that way, they never intended to have a special election, and if Bartowpolitics.com and Cartersville Patch hadn't told the whole story, this special election would not be happening. Ms. Sullivan also said she won't step down because she doesn't want to abandon her post. That would be like me receiving stolen goods but telling the owner I was not going to give the things back because possession is 9/10 of the law and requiring the owner to sue me to get his own stuff back.

I just read the Daily Tribune's take on the statement Nelson made. It appears that they had questions about the facts of the board retreat timing as well, and early correspondence with Dr. Harper over the matter seems to actually back up Ms. Gray rather than Dr. Nelson. Seems like on several issues (the retreat and the board appointment, in particular) Dr. Nelson is giving conflicting statements in a lame attempt to cover the rear ends of the rest of the board.

Here is what the Tribune reported:
"One item in particular -- the Feb. 27 board budget retreat at Berry College in Floyd County -- was questioned by The Daily Tribune News and prompted a correspondence with a lawyer from the Georgia Press Association. While the meeting was advertised legally and the DTN was in attendance, questions remained over how the meeting was conducted, and contradictions exist between the statements made by Nelson and Superintendent John Harper regarding the meeting's operation.

"The five board members received correspondence from the superintendent that the meeting would last from [1 p.m. to 4 p.m.] and would cover his budget recommendations," Nelson said. "... Dr. Harper gave his report that lasted about one to one and a half hours. We then took a break and Ms. Gray got her stuff and left. Soon after she left, the newspaper staff left.

"... The group reconvened and discussed the superintendent's

recommendations until around 4 [p.m.] or 4:30 [p.m.]. The meeting was adjourned and the minutes were kept the same as they had for all previous work session retreats."

The DTN did leave the meeting at the point at which the paper believed the meeting was adjourned -- the point Nelson considered to be a break, according to his statements. This varies from Harper's response to a March 21 email in which he said the meeting was adjourned before the DTN and Gray left, saying some board members remained after the meeting was adjourned to ask questions.

In other words, Harper previously confirmed to the DTN the meeting was adjourned and had not reconvened to discuss the budget without the knowledge of the press and Gray.

"I made my presentation at Berry and the meeting was adjourned. The meeting was not reconvened," Harper said in the email that was later sent to the GPA. "[Reporter Mark Andrews] and Ms. Gray left the meeting. As I was preparing to leave, some of the board members asked me for clarity of some of the items I presented and I answered their questions.

"Some thoughts were expressed about how difficult it was to make some of the cuts necessary and how some of the members felt about some of the recommendations. No decisions were made and I could not tell you how long we were there."

What surprises me most is that the Daily Tribune is actually taking on Dr. Nelson's view of things instead of sweeping it under the rug...

From what I have heard presented at the county board meetings, the old Cass High is being turned into two things, a Learning Center that runs out of computer labs that is a program completely run by the local schools and a College and Career Academy that is run by a joint board between the community and the school system. It is basically a system sponsored charter, which would be different from a charter school started by an outside group.

From what Dr. Sabin has presented, the charter application is being written with community and school system members represented. The chamber is heavily involved, but it is all being done under the umbrella of the local school system. I am sure the school system would be glad to provide you any information on the charter application that you would request, and some of it is contained in the board minutes. Dr. Sabin did an extensive presentation on it during the June 11th work session. The video is available here: http://www.bartow.k12.ga.us/education/compone...

So I don't think the old high school is getting a face-lift to "lure" the right charter. They already have a plan for the school and have been working on it all year. Hope that helps clear it up some...

We intend to release voting records in the near future. This would include whether candidates consistently vote when elections are held and whether/which party they vote during primaries. Make sure you are informed before you head to the polls in July.

When AdvancEd-SACS come if anyone wants to meet with the review committee you will need to send a letter to them ahead of time asking for an face to face meeting. It is helpful if you go to their web site and review the indicators under the standards of governance. You need to decide which indicator the Local School Board is violating so you can give "evidence" and "artifacts" that support your contention. Take some time and look carefully at the actions of Davis Nelson and cronies to see if there is a real and present danger to your Public Schools.

You have to attend school board meetings and ask questions. Carefully review minutes and supporting documents. Remember there is very little in the School Boards records except student's private files and restricted personnel files that are not fair game for close scrutiny.

It takes time and effort to be an educational watchdog!

Ms Sullivan is a very well spoken lady. Greg Bowen is the more experienced and smarter of the two and he has a record of doing good things while on the Board. Plus, he is the one to keep Davis Nelson honest.
