The man was drunk and should never have been behind the wheel. I am confronted almost daily with jaywalkers. However, since I do not drive drunk I am able to avoid hitting them however stupid they may be for jaywalking.

If this POS walks, the jury needs to be cited for failure to enforce the law. Just like a rear-end collision, the guy in back is ALWAYS at fault. Fierro KILLED an innocent guy and needs to pay with his life (or at least a severe conviction with a bunch of jail time!
They are correct when saying that jaywalking is not a crime punishable by death. DUI to this extent is.

This guy is a smug POS. I hope the jury convicts him! He is trying to place the blame on the victim. He needs to take responsibility, which of course he won't do.

Carlos Fierro needs to own up to his actions and quit blaming the victim. If it wasn't for Fierro, William Tenorio would still be alive.

I am a new resident of New Mexico. I have followed this case closely. I think its appalling that we are even having this duscussion. If you are impaired and make the decission to drive you are soley responsible for your actions irreguardless of you your profession or status. It is not the responsibility of others to manage your judgement or lack there of. It concerns me deeply that New Mexico judicial system has allowed drunk drivers to continue to operate in your fine cities putting others in harms way. How many other lives have to be taken befor this point is taken with the seriousness it deserves. Maybe if a judge looses a love-one I guess it will matter then.

I am always amazed that people feel the need to throw out the race card. I myself am a minority and NEVER do I think things happen due to race.Focus on the facts!

Did anyone watch the news last night? Did anyone see just how many people this year alone have gotton killed by a drunk driver in the four corners area alone? And the jury is actually arguing about this. He deserves to go to jail. He killed a man and I'm so disgusted that his freedom is even an issue. The only thing they should be arguing about is which prison in the state to send him too. Let Fierro off for this, then the state might as well just let all the other's who were drinking and driving facing vehicular homicide off as well. Fierro is no better than any of them. They all used their vehicles as weapons and killed fully knowing when they got in those cars that they were too drunk to drive.

What exactly are they deliberating? What to have for lunch? This case seems like it is open and shut.

By the way, "a-parent", in a rear-end collision, the guy in back is not always at fault. Ever been cut off? There is such a thing as comparative fault in these United States.

i concur, Race is not applicable to this trial. Mr. fierro knows that the whole of NM is watching and he has really limited amount of resources to be exonerated by the courts....

Awww....another poor victim being held down by the white man. Poor thing, maybe one day you'll have the backbone to take responsibility for your own situation. But then again I doubt it if you're making stupid statements like that.

I bet dollars to doughnuts he will walk. I know someone who wasn't drunk who hit and killed a person who was drunk, in dark clothes on a dark rainy night and they found her innocent because it wasn't her fault the guy walked in front of her. She was NOT drinking. He is a lawyer and probably knows about this and threw it in to make the jury think about it.

It is difficult to understand why it is taking the jury so long to decide this case. Unless, of course, there is some hanky-panky going on with one or more of the jurors.

I'd bet there's a juror with a DWI or a family member with one and doesn't want to convict...obviously there's some foot dragging going on here....not a good sign. Even if he walks he'll forever be the "O.J." of NM.

Third day? for what? This is embarrassing! I guess we should all start wearing Orange Barrels at night. The bars should hand out bright orange vests maybe. This is upsetting to me. Mr. Tenorio I am very sorry, RIP!...

It's unbelievable the jury is having such a hard time. Carlos is GUILTY of killing another human being because he was stupid enough to drive DRUNK. If you take your chances driving when you are drunk, you have to pay for the results of your actions. RIP Mr. Tenorio. I am so sorry this happened and I don't even know you.

66-8-101. Homicide by vehicle; great bodily harm by vehicle.

A. Homicide by vehicle is the killing of a human being in the unlawful operation of a motor vehicle.

B. Great bodily harm by vehicle is the injuring of a human being, to the extent defined in Section 30-1-12 NMSA 1978, in the unlawful operation of a motor vehicle.

C. A person who commits homicide by vehicle or great bodily harm by vehicle while under the influence of intoxicating liquor or while under the influence of any drug or while violating Section 66-8-113 NMSA 1978 is guilty of a third degree felony and shall be sentenced pursuant to the provisions of Section 31-18-15 NMSA 1978, provided that violation of speeding laws as set forth in the Motor Vehicle Code [66-1-1 NMSA 1978] shall not per se be a basis for violation of Section 66-8-113 NMSA 1978.

D. A person who commits homicide by vehicle or great bodily harm by vehicle while under the influence of intoxicating liquor or while under the influence of any drug, as provided in Subsection C of this section, and who has incurred a prior DWI conviction within ten years of the occurrence for which he is being sentenced under this section shall have his basic sentence increased by four years for each prior DWI conviction.

E. For the purposes of this section, "prior DWI conviction" means:

(1) a prior conviction under Section 66-8-102 NMSA 1978; or

(2) a prior conviction in New Mexico or any other jurisdiction, territory or possession of the United States, including a tribal jurisdiction, when the criminal act is driving under the influence of alcohol or drugs.

F. A person who willfully operates a motor vehicle in violation of Subsection C of Section 30-22-1 NMSA 1978 and directly or indirectly causes the death of or great bodily harm to a human being is guilty of a third degree felony and shall be sentenced pursuant to the provisions of Section 31-18-15 NMSA 1978.
