I got served with rent and possession yesterday bc I have not paid rent for a month and a half. My landlords are wright properties and have asked several times for them to come fix my air conditioner....I have a 5 year old child and its been 90 degrees in there. Also asked for a window unit and never brougt me one. I filed a complaint with city hall and still have not heard nothing. When I called Mr. Wright and told him of my problems he said if its too warm then mayb I should find another place to go. So I did. My place will be ready on the first of September and they know this....they called my new landlord asking when it will be ready but has never tried to contact me to get rent or fix the issues....so what my question is when I go to court on the 20th what should I expect? Are they going to keep my stuff that day of court or will they grant me more time to leave cause I will be out by the first anyways....any feedback will be very appreciated!

A landlord has to provide you a dry place to live with hot and cold water. They do not have to provide air conditioning. You are expected to pay rent and will probably be asked to pay what you owe.

Yes but also they have to make sure there living environment is up to code and everything is running properly and they have failed as landlords to comply with there agreement.

If you have enough money to go rent a different place then why didn't you just go buy your own window unit to use since you are so concerned about the child being hot? I hope they boot your ass out and recover any money you owe them.

Well smarta$$ if u must know he stayed at my parents when it was hot in there...u don't know the whole situation that was just a summary of it so people can give advice. So thanks for your smart input!

Had you provided the "whole situation" you might have received different responses.
Something doesn't pass the smell test.
If I were your landlord and you were behind 1-1/2 months in rent I assure you there would be no AC. You're living rent free and YOU expect amenities? Geez!!

So you want people to give advice based on half the story? You seem like a brilliant one. Like I said I hope they boot your ass out and collect what you owe them. You still never said why it is that you couldn't just go buy an ac of your own. Sounds to me like you just want something for nothing.

If you paid your rent he would have money to fix your AC. You must not be a very good tenant if you had to rent from Wright Properties.

I'm not from around here. I did not know that's how they were. I was up to date on my rent til this happened. I called n asked to have someone look at my ac n he said if its too warm then mayb u should find somewhere else to go....then they had told me they was going to send someone out I was first on the list. No one ever came. Then they was gonna bring an ac unit. Never called or showed. So that is why I did not pay rent. This happened weeks before rent was due. I have had many other issues go wrong that they also not addressed but the ac was my main one....I would have been more than happy to keep up on my agreement if they had there's. I've filed complaints with the city and they got health violations for things I didn't know was wrong with my place. I just wanted to know what will happen when I go to court....just wanted advice from someone who has been in similar situations. So with all that being said that is why I had not paid rent. They know I'm leaving and know I filed complaints. They called my new landlord to ask him when it will b ready but couldn't call me.

Sorry to hear about your situation.I don't know anything about rent and landlords . All I know is I would be a little upset about the air conditioning. Any of you would.I mean come on you know hot it has been.I hope you get to keep your things.

Tell your story to the judge. Get a copy from the city of the violations. The old story I did't pay rent because he did't fix something will get you no where. Mo law say,s you can only withhold 1/3 of one month rent and it has to be put in a escrow account. You may only do this once a year. I haven't head the ruling on health violations. Please let us know the out come.

Boy, There sure are alot of you on here that act like your turds don't stink. Quit acting like everything in your life goes like a well oiled machine. You ppl make me sick with you holier than thou comments when in all probability you are meth heads that steal from your own families. All she wanted was a little advice not drug through the wringer because you think you know the whole situation. I swear everyone in this city are just as they always were. Call the court and try to get a continuance. You might be able to get the date put off for two weeks. Wrighr properties are known slumlords here so that may help you in court somewhat. It usually takes ninety days to get evicted. Take pictures of anything broken that was not repaired. clean the place up very well when you move, nothing looks worse than dirty pics of your old place from the landlord in court. Not paying rent will go against you in court. It is not a defense.

Its easy for people to take out their anger when sitting nameless behind a computer. I agree that all she did was ask for advice. Big deal. People are so miserable these days they jump at tge chance to attack one another, and why?? Why go out of your way to deliberately be an asshole? Thanks to those of you defending me...your right I guess it must be nice to be so perfect as them..I'm sure they have probably done worse things than this in their lives! Im still hoping it all turns out for the best. As far as I hear they should let me stay til the first which is all I need. I want to pay what I owe to wright properties but they have been nothing but rude and inconsiderate and even said they did not do there jobs as landlords so I don't feel I should. They screwed me so its only fair. But I will probably pay anyways cause I'm just that type of person. Thank u for the advice!!

You can go to court and ask for an extention to give you time to find a place and get your personal property the court will give you that extention however you still will have to pay the back rent and rent up to when you leave and return the keys to the slumlord. Bend there done that.

Being served for "rent and possesion" means he is sueing you for your back rent and possession of the apartment, not your possesions. Basically the first step to eviction , which means you show up to court and pay your rent or don't show up and don't pay and the landlord gets his eviction notice and then the Sherrif shows up and dumps your stuff on the curb and you are kicked out and the landlord changes the locks and rents to someone else. Now whether he "has " to fix your ac is based on whether it is in your lease that it is provided, since it was there in the first place you would probably have a good case in court but you threw that away when you decided to not pay rent. I am not a lawyer so I don't know all the details but in mo the landlords have more rights than the renters and if you are going up against a large property owner you are not going to win in most cases. If I were in your shoes call the landlord and get your stuff out and store it where you are staying if you can and turn over the keys and pay your back rent. If you get a decision against you it will be really hard to rent anything in Cape for sure and maybe anywhere if the landord get the eviction on you and reports it to the credit bureau..
