PITTSFIELD -- If Berkshire District Attorney David F. Capeless has his way, three men who are accused in an August 2011 triple homicide will be tried together.

Capeless has filed a motion to join the cases against the three defendants -- Adam Lee Hall, David Chalue and Caius Veiovis -- in the kidnapping and slaying of Pittsfield residents David Glasser, Edward Frampton and Robert Chadwell.

Berkshire Superior Court Judge Daniel A. Ford on Thursday told the defense attorneys for the men that they have until March 25 to file their oppositions to the move.

Hall, 36, of Peru -- an alleged member of the Hells Angels -- Chalue, 46, of North Adams, and Veiovis, 32, of Pittsfield, were indicted and arraigned in October 2011 on multiple counts each of murder, kidnapping and witness intimidation. They all have pleaded not guilty and remain in jail without the right to bail.

Glasser, Frampton and Chadwell disappeared Aug. 28, 2011, from Glasser's apartment at 254 Linden St. in Pittsfield. The men's dismembered bodies were found buried in a trench on private property in Becket on Sept. 10 of that year.

Hall allegedly carried out the slaying to prevent Glasser from testifying against him in an upcoming trial; Frampton and Chadwell allegedly were killed to ensure there were no witnesses.

Police say a fourth defendant, David Casey, 64, of Canaan, N.Y., used his excavator to help bury the bodies and was charged as an accessory after the fact. Casey

said Hall intimidated him into helping with the burial, according to one of his attorneys.

In his motion, Capeless gives three reasons why the court should try all the defendants at one time.

The indictments "arise out of a course of criminal conduct ... connected together or constituting parts of a single plan or scheme," the motion reads.

Capeless also points to "judicial economy" in avoiding three lengthy trials based on the same evidence as a reason to keep the cases together. And he believes the move wouldn't be "unduly prejudicial" to the defendants.

James Gavin Reardon Jr., who represents Veiovis, told the court on Thursday that he believes his client's case should be severed from the others because it is less complicated.

"Frankly, there's less evidence against him," Reardon told the court.

Reardon as well as Donald W. Frank, who represents Chalue, told the court their motions to sever would likely be based on "Bruton issues," referring to a 1968 federal Supreme Court decision in which a defendant had his conviction reversed because his co-defendant at trial implicated him in the crime.

In this case, it appears Hall may have made statements concerning his co-defendants.

"He's a very chatty fellow," said Frank, who told the court that Hall "continually approaches the Commonwealth" and provides "information on various people."

According to Frank, Hall has given book-length statements to the police. "It's 450 pages long," he said.

Hall's attorney, Alan J. Black, conceded that his client "has talked quite a bit."

Black on Thursday filed a motion for a change of venue due to the publicity in the case.

While Ford set a March 11 date to file any motions to dismiss the case, no trial date was discussed and no further court dates were scheduled.

Attorneys in the case have agreed to ask the Chief Justice of the Superior Court Barbara J. Rouse to appoint a single judge to handle the case. Ford said he wouldn't set any further court dates until a decision is made by Rouse.

I knew Capeless would pull through. All three of these men are affiliated with the Hell's Angel's NOT just Leo as the Eagle reports from sources trying to protect the disgusting club house in Lee. I am tired of hearing that the Hell's Angel's are good guys, BS they are!! You can't put the words Hell and Angel together and think they are good people, they are scum bags, every single one of them and their so called associates!! They have no respect for the law, they think they are above the law and their true colors are coming out.It's about time people realize that their many Fund raisers are all you want to for the needy, it's all a facade! Capeless is no dummy, he has all his T's crossed and I's dotted. Just wait and see when ALL the evidence comes surface. I have always had faith in him, while others bashed his capabilities. Go get him Mr. Capeless! I hope ALL the Hell's Angel's get run right out of this town when the truth comes out, oh and it will, not a doubt in my mind.

Dear "Where is the justice," Your confidence in Capeless is, well, unbelievable. I hate to be the one to break it to you, but, the "law" has no respect for the "law." The "law" disbehaves like they're about the "law." That's not to say that the Hell's Angel have any respect for the law but to the best of my knowledge the Hell's Angels never swore an oath to unhold the law and then shit all over it. That's not to say they never shit all over it, but I'm pretty sure they never swore an oath to uphold the law either. Before Adam Lee Hall allegedly murdered three men, dismembered them and buried them in a boulder covered trench, before that ever happened, Adam Lee Hall had been allegedly implicated in a number of violent crimes and both Capeless and his dead predecessor Downing failed to bring the hammer of justice down on Hall. Before three men were brutally murdered, dismembered and buried in a boulder covered trench the FBI considered Hall to be "uncontrollable" and "much too dangerous." So again, your confidence in Capeless and the "law" is, well, unbelievable. I believe Capeless and the "law" failed the three murdered men and others miserably. But I've heard this is a free country where both you and I are free to believe what we want.

Dear "Where is the justice," While I won't swear to it, I believe it was Capeless, the defender of justice, your hero, who said that Adam Lee Hall's records of multiple alleged violent crimes against others before Hall allegedly murdered, dismembered and buried the grisly remains of his three victims, in this case, were in deep storage. Maybe they were put into deep storage so no one accidently came across them and wondered why in hell Hall wasn't ever prosecuted for any of the multiple alleged violent crimes he allegedly committed before he allegedly murdered three men.

Yes, DA Capeless told the Berkshire Eagle that all those files of the heinous and vicious crimes of Hall were in deep storage and freedom of information act to see them was denied.

Also Adam Lee Hall's application to become an FBI informant was denied because he was considered too dangerous.

Yet, still he is a "chatty fellow". Revealing all the secrets of the Hell's Angels motorcycle club.

of corse he wasn't prosecuted on any of the other violent crimes,capeless has seen to that. probably will come out that hall has been a informant all along, and once more he will get off. he is a very chatty fellow.

He is an informant. He was only trying to scare the hell out of Glasser and his friends. It was the other two schmucks who took it too far.

Hall couldn't stop them because it would have blown his cover. It will come out in court, someday.

perhaps putting hall on trial would bring to light serious missteps of his previous court dealings. Perhaps the DA could come out looking really bad and further embarrass local law enforcement. when nobody talks about something there is usually a hidden agenda
