You go down and pay the ticket all the while thanking the Lord that it was a ticket. You could have been broadsided at the intersection then, without your seat belt fastened, you could have been thrown from your car and run over by a tractor trailer. IT does happen. Even to people you know.

It is the law that you must wear a seat belt. Maybe you do not agree with the law. But if you ride without one, then you will get a ticket, or worse. A reasonable person would fasten his seatbelt. Especially if he pays any attention to the way people drive around here.

I agree with you 100% It is insane that you don't have to wear a helmet on a motorcycle. I personally think this should be a ticketable offense as well as seat belts.
Riding a bike is a choice, you can wear a helment if you want too. You can choose not too. There are no babies on a bike. All kids must wear helments, any person riding a bike less than a year must wear a helment.
The only difference in wearing a helment or not, is a open or closed casket. In fact wearing a helment gives a rider a false sense of security. When your brain is exposed, you think alot more and ride safer. When you hit a car head on, nothing, but Jesus, is going to save you, not even a plastic helment. Mass Trama, not head trama, is the cause of most biker deaths.
Soccer moms on cells phones are the reason for most biker deaths, that and these parents letting these teens drive those crouth rockets that goes 240 MPH.
I was on the rescue squad for alot of years and only seen one time that a person died that would have lived not wearing his seatbelt. The car went off the road, the frame bent down and the seatbelt cut the man into. That is (ONE) time out of thousands I went too that seatbeat probably did save lives.
I didn't like it when they made me buckle up either, but it is alot safer, and most accidents happen 15 miles from home. Anyone with any kind of horsesense buckles up on the interstate, why not do it where stats says your probably going to have an accident at?

I was pulled over for not wearing my seat belt. When the cop asked why I didn't have it on I replied that my 2 year old son learned how to get out of his buckle so I have to unsnap it to be able to reach back and snap it again. The son of a ***** still gave me a ticket. The fine here in Texas is $50 max and $96 court fee's. I argue that court fee's is unjust and very high. The law states "not less then %25 and not more then $50. Mine is $146!!!!

The state of Missouri is $10. NO COURT FEES!

Yes, the seat belt law is unconsititional and violates artice 4, 9, 14. I am in the process of arguing the fact and will appeal as much as possible

It amazes me that so many people can use a computer and not have a brain.

Seat belt laws are unconstitutional. That is why so many people argue unconstitutionality.

The courts do not have jurisdiction over every aspect of your life. Each individual is a sovereign entity and the law and government is granted powers by the sovereign. So, in the case of seatbelt laws, the one not wearing a seat belt is the only sovereignty involved and can decide not to grant jurisdiction to the courts.

The reason the constitutional argument fails is that we are stupid and refuse to stand up for the rights of other sovereign individuals. Not to mention, the deriding stupid bloggers unleash through name calling and bad chat room advice.

A bigger problem than a $10 ticket is that these types of laws will expand if not contested. Go out and fight for all your rights no matter how small. If you don't we may find ourselves in the position of not having enough rights left to fight for the ones that we care the most about.

Look up Yick Wo v. Hopkins 118 U.S.356
"Sovereignty itself is, of course, not subject to law, for it is the author and source of law; but in our system, while sovereign powers are delegated to the agencies of government, sovereignty itself remains with the people, by whom and for whom all government exists and acts."

For those of you who answered just wear your seat belt...

Well I got a ticket for not wearing a seat belt when I was wearing one. I even showed the officer that I was wearing it & she claimed I put it on after she pulled me over. Gave me the ticket anyway.

Why should I have to pay for something I didn't do?

Yea it does help to be one of the GoodOleBoy's, but thats not the way. You have to learn the laws and rules for cops. Ive beat seatbelt tickets in other counties, and ive beat state troopers right on the roadside. For the seatbelt, just argue that its unconstitutional (Which it is) and threaten to fight it all the way up if you have to. theyll usually just drop the ticket rather than risk bad publicity. And if you know the laws well, almost every time a cop pulls you over he breaks some kind of law. I once had a cop (not in c-ville, and dont ask) pull a gun on me because he panicked when he saw my pitbull in the backseat and then threatened to hurt my dog. i replied with "you hurt my dog ill shoot ya between the eyes with you own damn gun" and when all was said and done, he apologized, let me go, and begged me not to report him. And i was going 80 in a 35! Study the laws people, itll keep your ass out of jail or a ticket.
Why are people always trying to beat the system? Just do what you are supposed to do, and dont do what your not! Its that simple. The cops are there for a reason and its so your dumbass doesnt hit me b/c you are going 80 in a 35. When they have to unwrap you from a tree you will wish that you had been obeying the law.

The reason we have a seatbelt law but no helmet law is simple.
If you don't wear a helmet COPS WILL SEE YOU, so you will always wear it. Some people however will be too stubborn to wear a seatbelt thinking cops won't notice, and therefore the state will generate huge revenue from the seatbelt fines. It has nothing to do with safety. If it did, there would be a helmet law! Understand?

you are right, it is a choice, but even though it is a law, pullover half of these bikers and see how many SHOULD legally be wearing a helmet. And if it is a choice to ride a bike with or without a helmet then why shouldn't i have the choice to drive a much safer car with or without a seat belt? put some of the dumbasses on their bikes with no helmet, me in my car with no belt, let us hit head on at about 55mph and see who has the best chance of eating supper that night with their families. lawmakers are ignorant to everyday society. they just pass laws that makw them look good for re-elections and shit. they could give a damn less if it does any good. And just for the record, i feel that yes minors should wear seat belts, but taxpayin American adults should have the right to make their own choices in this "FREE" country. Untill then i guess i'll just pay my fkn fines if one of these dirty/corrupt fkrs actually gets me, thats my choice as well. lmfao
