I am left with the question of whether the chaplains can perform same-sex MARRIAGES in states that allow such things. DOMA doesn't forbid same-sex unions, so DoD is on solid ground here, but DOMA does address same-sex marriages. It appears to me that (based on this report) DoD has forbidden its chaplains to perform same-sex marriages, even in the context of chaplains from the United Church of Christ or the Unitarian-Universalists (both of which honor same-sex marriage). Thus, it appears that DoD is allowing their chaplains to do pastoral care so long as it has no legal implications.

This declaration will be all Little Rickie Santorum, (former Sen., PA, Frothy Lube Party,) will need to declare in his next debate for the Tea Bag brain dead that military chaplains are now required to have homosexual relations with service members.

Go to the DOD website and it's clear.

Military chaplains CAN perform marriage ceremonies for same-sex couples on or off base so long as it is legal in that state.

DOMA only addresses the definition of marriage in the context of obtaining federal benefits. NO WHERE does it say gays can't get married, just that the feds won't recognize any such marriage for benefits.

This is a clear case of religious freedom- ironic isn't it.

I predict a loud-but-short-lived boom. It was foolish to release this directive prior to the official end of DADT--it's red meat for the homophobes. There are still a few who have not accepted their utter defeat at Obama's hands, but they're less and less relevant every day.

Most Americans understand that the military has no business proscribing chaplains from performing legal, peaceful, and non-disruptive ceremonies.

I would actually love to see the Religious Reich try to sue to stop the chaplains from performing same-sex marriages....

Wouldn't it be interesting, after all their screaming and crying about marriage equality taking away their religious freedom, if they were actually stupid enough to try to sue to stop other people's religious services????

Of course, we all know that they've been trampling all over every one else's religious freedoms since the first Europeans started slaughtering the native populations "in the name of Christ" so they're obviously comfortable with the concept....

Does anyone else see this as a step in the right direction for the repeal of DOMA? I think this might be a kind of pre-step to the future on this one.

One thing is for certain, the GLBT community cannot afford to see a Republican win office in 2012.

DOMA is already all but dead. The WH and Justice Departments decision to no longer defend it pretty much nailed the casket shut. It's all downhill from here although I would really, really appreciate it if the House Republican attorney defending DOMA would lose a couple big cases. That would help as much as this move by our armed forces. Defending the indefensible and that natural loss really helps future legal cases a great deal.

When military gay married couples return home after their tour of duty; their state and local governments will have to record and coordinate their military marriage records at the local courthouses; if for no other reason but to keep geneology records straight without falling hopelessly behind
