State v.Jos.S. Kyle on Circuit Court Criminal Docket for Tue Dec. 11th

An "informed Source" emailed me today telling me they had dropped into the Circuit Court Clerk's Office and this case is indeed still scheduled and on the Docket for next Tuesday Morning.

Seats may be limited.

Postponed or continued. The difference? It was scheduled for a different date. Nothing has changed. The case has very little merit, especially once the eye witness is allowed to testify. And even if convicted it is not a felony charge. What are you going to concern yourself over after Tuesday?

I have enough faith in a Benton County Jury to have confidence they can see right through perjured testimony.

Maybe the choice of a young lawyer admitted to the Bar in 2008 whose experience is mostly in Divorce Litigation was not only because a new lawyer without experience and reputation is many times less expensive, but that this choice may have had "dual" purpose. Stated another way, maybe there is also a separation or possible pending Divorce "in the works"?

"Informed Source" says 'Missus Commissioner Kyle' has had it with him and is about to 'put him out'. Remember he moved into her home in 2010 on the basis of his house needing reparirs or not being 'habital' and never left finally managing to get her to marry him about a year ago. He has never had a job, she does. He does not drive because he does not have a driver's license so Missus or someone else must 'chauffer' him around as he conducts his important 'Public Business'.\

Apparently she did not know nor had he sharred all of his Past with her and this new arrest of her new "Husband" last March on Criminal Charges has proved to be very upsetting and stressful, especially to someone who has lived in the Community all her life, was respected and even respected enough to be elected to Public Office by her neighbors. This is said to be one of the reasons he has 'disappeared' from County Commission Meetings and other Public Meetings involving Commission Committees and also hanging around the County Offices on a daily basis.

Maybe after all this and the embarassment the "Missus" is going to be looking to change her status??

"Informed Source" says this latest event and criminal matter is the "straw"......Missus reputation has suffered enough, she has lost too many friends, etc. Maybe the 'Divorce Lawyer' was dual purpose??

The real question is will this well known "best friend, constant companion/chauffeur and fellow Benton County Beer Board Member Buddy" be willing to purger himself under oath to try and back up the claim of the Defendant??

This Defendant wants you to believe this will come down to his word against the victim's word, a he said, she said.

The background of the perpetrator then becomes very relevant and previous felony convictions for Criminal Trespass, Burglary and Theft then can be in play. Does the 'Benton County Beer Board Buddy', Bob Pace, want to align himself and his credibility with that of the Defendant whose past is well documented?

What will Bob Pace do? Was Bob Pace smart enough to consult with a lawyer? There are at least a couple of County Commissioners that thought he should have also been charged as an accomplice in the Crime.

Someone private messaged me and asked me to explain what that reference was to "Joe Kyle bailing out his Beer Board Buddy Bob Pace?"

What was that all about, when did that happen and is it important, was the question?

My answer comes from information from "Informed Source" who has sent me an article from the Chronicle stating that in the Summer of 2011 Bob Pace was arrested by the BC Sheriff's Dept for assault on an Officer.

The background provided to me was there was some legal process going on like an eviction or legal repossession action going on under the auspice and supervision of a BC Sheriff's Officer when Pace who was alleged not to be completely sober, stepped in and tried to take charge of the situation telling the Officer he knew the party, was acquainted with the facts and besides he, Bob Pace was a Former Benton County Commissioner and that this Officer needed to back off and in the process of doing all this, Pace grabbed and restrained the Officer. Not a smart thing to do because when Pace finished his oratory he was promptly arrested for assaulting the Officer.

Pace was taken to Jail and his entitled phone call that day went to his buddy Joe Kyle who with Debbie Dye showed up shortly to bail him out of jail.

Now, is this IMPORTANT to know, and does the Prosecutor know about this documented event???

The fact that the only witness the Defendant in State v. Kyle will be relying on is a long time friend who had been aided by Kyle when he had a problem with an arrest is perhaps a material fact the Prosecutor should know in determining the reliability and veracity of this Witness.

Any trial lawyer will tell you it is material. What are other circumstances and facts that could be material affecting the Defendant and his only witness??

A good Prosecutor will always look for any quid pro quo and dig into the history between a witness for the Criminal Defendant and the Witness.

I can be private messaged by anyone having any knowledge about this subject.

I saw in the paper today Tony King got a deal on some new seats.There was a picture of inmates installing them. Just in time for Christmas.Maybe more people will come to commission meetings now.y Butt couldn't hardly stand the old ones. Thank You Mr King !!!
