When you spend this kind of money,$124,000 to win a lawsuit and then refuse to pay additional legal fees to fight the appeal of the losing party, you have got to be smoking something.

The other party would win the appeal and you still have the EWS facility in your back yard plus having paid out the $124K.

Maybe she has joined hubby Joe in "Huffing" her way into so other realm of reality.....hanging around with this character for very long can be dangerous to your mental health, maybe bring you new vices and habits too?

Backing and voting for one of Joe Kyle's Crony Buddies, Bill Nobles, just confirms that Commissioner Kyle is under the influence of something....what is she sniffing these days??

They Authorized the payment of invoices for legal fees associated with EWS lawsuit. the County has already spent $124,000 in this suit; Funds were appropriated for computer support for the Juvenile Court and Detention center; A motion was made by Commissioner Kyle to enforce a law holding the County Mayor personally responsible for over-spending beyond the appropriated limit, earlier sent by the commission. This was referred to the Ethics committee.-

Instead of pursuing the County Executive Mayor Barnett for an "ethics" violation for not controlling the total fees for an outside attorney working on behalf of the County and where the attorney bill exceeded authorized spending by $24,000. We are sure Commissioner Debbie Kyle would want the Mayor to repay the $24,000 overage out of his own pocket.

Commissioner Debbie Kyle forgets it cost Benton County more than $24,000 last year to Arrest, Prosecute and Convict her husband Joe Kyle on a Criminal Charge and the County is still paying as the Convicted Party, her husband, appeals his conviction with the Tennessee Court of Appeals. The County also had to utilize a Grand Jury to Indict him when he failed repeatedly to show up with an attorney and enter a Plea.

Perhaps Commissioner Debbie Kyle should also pay the County back the $30,000 or More this case has cost the County and taxpayers thus far??

How about a Citizens Petition asking for this to happen and then present it to the County Commission with a few hundred voter's signatures???

Damn JD breath then review the law in both and facts in both cases and see why the Mayor show be heard personally responsible for his illegal actions and why Joe has a valid appeal for the wrongful action taken against him. The story the victim actual told was so much different from the story your hog farmer boy friend told her to tell.

An appeal or re-trial is only granted when a "judicial error' exists..what was the Judicial error that occurred in this instance??

A challenge to 'sworn testimony' by the other party is not judicial error.

JD open your EARS... and Shut your MOUTH for a second and read what I said again. Go read the law, then reread the testimony, then read the findings and you will clearly see where the error exists. But of course you won't because you are so blinded by your bias that you would never admit the truth if it is in Kyle's favor.

The wife says her friend who works for the Court got to see/listen to a video the Sheriff made the day Joe was arrested......he was all drunked up and cussing everyone out...,,apparently that tape did not get played at the trial....if there is another trial maybe they will use it??

Hey, this could be a two-fold in helping Benton County's financial burden:
1) I agree, get a petition circulating signed by citizens requiring commissioner Kyle to repay the $30K spent on her husband's trial & present it to the whole commission body the 3rd Monday of this month. She'll see then who really values her opinions/recommendations monthly when they vote "Aye" for her to repay.

2) Go forward with a retrial of Tubby Kyle & hopefully the Judge will force him to stay in Sheriff King's motel the whole 12 months! Now, the county & state WOULD save money since Tubs declares to be an attorney. With Sheriff King's sophisticated facility, he probably has close circuit tv's. Money would be saved by allowing J. Tubs Kyle, Esquire to enter pleas from his 6X6 jail cell on behalf of those charged, saving countless dollars that goes to the Public Defender's Office.

Finally we get some citizens thinking creatively about financing and how to correct problems......this needs to be put in front of the Commission!!
