Joseph Samuel Kyle was convicted by a Jury in Benton County Circuit Court in a January Trial for Aggravated Criminal Trespass. He was arrested when a 72 year old homeowner discovered him in her home in March 2012. Kyle, a very outspoken Benton County Official claimed loudly he was innocent and said he would fight the charges when he was arrested.

He failed repeatedly to enter any Plea at his scheduled arraignments asking for extensions claiming he could not find an Attorney. Finally the Benton County Grand Jury Indicted him last September and the Circuit Judge C. Creed McGinley ordered him to report for a December 2012 Court Date admonishing him to have an attorney and denied the motions he tried to file Pro Se. In December he finally showed up with Counsel and the Date of January 17, 2013 was scheduled for a Jury Trial. He was convicted and Judge McGinley set Monday February 25th for a Sentencing Hearing.

Conviction for a Class A Misdemeanor in the Tennessee Criminal Code carries a maximum jail sentence of 11 months, 29 days and $2,500 in fines and costs. Judge McGinley basically gave him the maximum in both categories. Kyle is to report back to Court on Thursday March 28th. Judge McGinley also issued a Court Order prohibiting Kyle from having any contact with the Victim.

Part of the one year Jail time may be offset with Supervised Probation the Clerk’s Office said. As of the end of the Day on Monday only the ruling was available from the Judge’s written notes given to the clerk and an Official Sentencing Document had not yet been prepared the Clerk reported. Part of the Order is for him to pay all costs of Prosecution and Court Costs which will include costs of Subpoena’s, witnesses costs, travel costs, etc. which takes time to gather and calculate but that will no doubt be done between now and March 28th and total costs will no doubt be a few thousand dollars.

Having Benton County fully reimbursed should be to Kyle’s liking as he and his wife Commissioner Debbie Kyle were vocal and active in saving County dollars by cutting the Funds given to the County Libraries, cutting the funds paid for County Employees and Sheriff Department Health insurance premiums and cutting off all County Funding to the Benton County Chamber of Commerce. In 2011 Kyle and his wife the Commissioner were instrumental in taking over the Management of what they now call the Benton County Sports Complex and bringing what revenue that generated back to the Control of the County. Obviously he does not want the County to spend unnecessary taxpayer money so full reimbursement for what it cost to prosecute his case should appeal to him, Commissioner Kyle and all the other County Commissioners pushing these cost cutting fiscal measures. He and his wife can be proud that he is finally “paying his own way” for County Services Rendered.

He will be given details about the incarceration on March 28th the Clerk’s Office said. When the final Court Order is prepared and signed and becomes part of the Criminal File and it will be available to the Public upon request. Judge McGinley no doubt took his previous convictions for Criminal Trespass, Burglary and other offenses into consideration before handing down this maximum sentence.

First no Appeal has been filed in this Matter.

And, NO, Commissioner,not correct. Sentence for incarceration was stipulated to be 11 months, 29 days and all of this will be a future event, so it is just YOUR speculation that it may only come down to 30 days.....guess that all depends on a lot of things and future events and his "future good behavior".....and "good behavior" for him is a huge speculation. You should know better than anyone else.

Yes, pay all costs but when that adds up to nearly the maximum monetary assessment possible under the criminal code.....what do you care what it is called? Besides YOU are the one who will eventually have to make the money good, not husband Joe and you know that.

With your influence and power can't you get him a job?

I am sure Slim might help out? What do you think?

ONE UP??? I don't have to go back to Circuit Court March 28th and find out when I have to report to the Jail to serve a sentence and to find out exactly how much I owe the Court for all costs of Prosecution in Matter. Don't Prisoners also have to also pay a daily cost or per day for time in jail too???

You can have your "one up" then if you want it, I don't. I will bask in knowledge that Joe is in Jail and I am not. BTW, when are visiting days, I think I should visit him and 'bask' in that experience too.

why didn't they just take him right to jail instead of hauling him right to jail? report to court a month later to find out a date to report to jail? sounds fishy to me. something isn't right.

He claims Tony is his buddy.Went to his wedding and all.Maybe in a month the penthouse will be available.Time depends on good behavior.Guess he's going to be kissing Butt for the next month.Maybe he can sell his mansion and pay the fines??

I have an appointment with an Attorney in the area and making an appointment shortly for near the end of March, so I will be planning on seeing you when I attend the BC Commission Meeting March 18th.'

BTW, your hubby Joe and his persona 'Aturney Ernie' have been on the giving end of multiple Civil lawsuits, it is about time you and Joe get on the receiving end for a change.

Joe has been wanting to get 'face to face' with me forever and with some bars between us he can't violate his Probation so that is why I was suggesting a visit while he was incarcerated.

I did call the jail and here is how it works: When he arrives at the jail he will be given a "Prisoners Visitors Card" which he fills out with the names of people he would want to visit him. He is also given his own time and days that his personal visits will be allowed so he can pass that information to persons on his list. The Deputy answering the phone asked which inmate I wanted to visit, but I had to tell him the prisoner had not arrived yet. He asked who it was so I had to give him Joe's name. He was aware Joe would be arriving soon so he gave me the 'drill' and told me to tell Joe to get my name on his list.

Therefore, please let him know that he needs to put my name on his list so I can come and see him. You of course need to be on that list too plus Bob or any other friends.

See YOU on the 18th. Maybe you can suggest a good restaurant for "Q".....that sounds good, I've been missing that.

Actually i thinking that along with picking up dead animals on the side of the road and doing roadside trash detail, he should also be allowed to wash police cars and spit shine a few ambulances.

Many of the inmates doing a long stretch here at BCJ are looking forward to the day the fresh meat arrives. Ole Joe might as well show up drop his drawers bend over and back in. Before his time is done he will have learned a new meaning to the term ~ASSume the position~
