I don't like this picture of Matt. I don't like his cheap ass smile. He looks like a smart ass...which he is so I guess it portrays him well. I knew Matt from Laguna Hills High School and it bugs me that he murdered someone. His picture says it all. Someone who doesn't even know Matt would think he feels he is better than everyone else...including the victim and the victims family.

He apparently has no regard for the life of another human being. It is so disturbing to hear about all the attempts he made on the victim's life, like he was hunting down Mr. Marmo which proves pre-meditated, cold-blooded murder, NOT protecting Butler. Maybe after he is convicted, Mr. Toerner won't be quite as pompous and arrogant, especially when he realizes how long he will be in PRISON!! My prayers are with the Marmo family.

The Trial Brief also gives details pertaining to Matt Toerner going to another residence where John Marmo was staying to hide from these evil people and Toerner had the gun and attempted to break into the home to shoot and kill Marmo until a dog barked and scared Toerner off. This definitely is premeditated murder.

I think the "proof" people tend to be basing their comments on is the confession from Matt and the Trial Brief which were released by the court for public knowledge. Matt's statement to the police alone was disturbing, not to mention the latest trial brief released. The trial brief says Matt's conspiracy charge date was changed because that is when the gun was purchased not when Matt first attempted to kill John Marmo. It looks as though Matt first tried to kill John Marmo in October. Even Matt stated he was there when Seth Hardy put the bomb on John Marmo's car. Matt might not have been the one who put the bomb on the car, but his actions indicate he was willing to see this person dead. I think Matt's own confession is proof he is a murderer...don't you? Matt said he waited outside this guys house and shot him as he was getting in his vehicle...I think that's pretty good proof as to Matt being a murderer.

There is plenty of proof that will be presented at Mr. Toerner's trial. As FckThat stated, people are basing their comments on COURT DOCUMENTS, not just personal beliefs. Just because you want to turn a blind eye doesn't mean everyone else who is following this horrific crime is ignorant and will ignore the facts.

I knew Matt and to say He is capable of murder well maybe, but 6months prior I doubt that I spent most of tlast year with Matt and Seth. I never took to Seth but Matt is kind of like a child very gullible. Never the less he is on trial now. "Matt is kind of like a child very gullible". That is unexcusable to justify murder. Mr. Toerner may very well have those characteristics and maybe was gullible enough to believe the recruiting tactic that Rebecca Braswell and Shannon Butler were being assaulted by John Marmo. However, even children know the difference between right and wrong and children know they aren't supposed to hurt one another. At 19 years of age, whether or not Mr. Toerner is "like a child very gullible", he should know that murder is wrong.

I don't think he tried to kill Mr. Marmo back in June of 2006, but he did a couple weeks prior to the murder. So what if Matt Toerner is gullible, there is a lot of gullible people who know murder is wrong. I'm said to be gullible and immature, but I know murder is wrong so does Matt Toerner. He talked Seth Hardy out of killing Marmo because he knew killing him was a mistake. Read Matt Toerner's statement to the police; I think you will see Matt knew what he was getting involved in and now regrets getting caught. He thought he was "protecting" the girls, but he knew killing Mr. Marmo was wrong. Mr. Marmo was really the one who needed protection!!

Just curious, I've read that Marmo and Braswell's divorce and custody battle were "acrimonious." Are there details to be had? I'm interested in seeing how the events played out that led up to someone deciding Marmo had to die, and whether that was Braswell's idea and she enlisted aid, or whether someone else thought they were being "helpful." (Spare me that kind of help!) Anyway, just gathering information for a possible paper on what contributes to marriages ending badly.

Witness tells of propane tanks taped to slain man's car

A friend of John Marmo Jr., who was shot to death in 2006, testified in court Thursday that under Marmo's car he found a propane canister strapped to the exhaust pipe with chicken wire.
It was the second propane canister found under Marmo's car in two weeks. Barely a month after the second container was discovered Oct. 28, 2006, Marmo walked out of his Camarillo town house and was gunned down Dec. 1.
Marmo's friend, Timothy Coon, gave the testimony in a videotaped session because he plans to be out of the country later this year when four defendants are expected to go on trial.
Prosecutors want to preserve Coon's recorded testimony and use it in the trials of three Navy Seabees — Rebecca Braswell, Matthew Toerner and Shannon Butler — who are charged in the slaying of Marmo. A fourth Seabee, Seth Hardy, has been charged with trying to kill Marmo, a former Navy Seabee, by putting the two propane canisters under his vehicle.
Prosecutor Richard Simon said Braswell's will be the first trial, which is expected to begin March 1.
He said Toerner might be tried with Braswell, but the decision has not been made. If Toerner is tried separately, his trial will begin in October, the prosecutor said. Butler is set for trial in June.
Hardy, who will be tried separately, has a preliminary hearing Jan. 24. No trial date has been set.
According to witnesses, Marmo and Braswell, who was his ex-wife, were going through a bitter custody battle over their 4-year-old daughter.
The four defendants appeared in court in jail attire and were seated apart in the jury box. Their four lawyers were seated at a nearby defense table.
Accepted a job in Japan
The testimony Thursday, during what is called a "conditional examination" hearing, was taken because Coon has accepted a job in Japan, where he will be beyond the reach of the court's subpoena process.
Coon testified that he found the canister while the car was parked outside his Camarillo house.
The first one was discovered under Marmo's car at a "smog" shop Oct. 14.
He said Marmo "flipped out" when he saw the canister and immediately called the Ventura County Sheriff's Department.
Marmo not contacted
Coon testified that he and Marmo would do a check under Marmo's car each morning before going to work.
The first canister incident was reported to the Ventura Police Department, and nobody from that department contacted Marmo, Coon testified.
Under cross-examination by defense attorneys, Coon said he didn't think the canister could explode because there was no "heat source."
"I don't think it could explode. He hadn't driven it," Coon said.
In earlier testimony, Coon described Marmo as respectful, courteous and never violent toward women

I was at butlers mass for that letter she had another seabee i can't remember his name writ it to get him thrown in jail, she also asked me to murder john marmo but i refused and reported it to my chain of commmand to bad nothing was ever done for this man

Hopefully, with any luck the suspects will face a trial come Sept. 9th and a punishment will be given so the Marmo family can have some closure. It wouldn't surprise me though if the trial is continued again because lawyers have a way of manipulating the court system. God Bless the Marmo family.

I knew Shannon Butler years ago......she actually lived with me. I just came across the news about the shooting today. I am utterly shocked. To hear of such a viscious act makes me sick. I want to know if there is any new updates on what happened. Or a way to look up case files. Any info would be greatly appreciated. Blessings go out to the victims family.
