How hard is it to understand that even if Rowling IS a millionare, she still has the right to protect her creative work? Jeez, people!

I don't buy SVA's crying either. If he had been so misled, then why in the world did in his email to Melissa Anelli (mentioned in court) say that he felt he had NOT been misled? Why would he ask there to be an idemnification clause to be put in his contract?(I fully believe he did and not them, as when I commented about it to him over in the "What's New" section on the Lexicon website, he did not deny it). Why would give endless interviews to fanzines and sites and mouth off about Jo's "power grab" and how a win for RDR would be a win for the fandom?

SVA is someone suffering through a mega-midlife crisis in a very public manner. He should learn something about choices from the books he so worships and hopes to profit from.

To everyone claiming JKR is "just greedy": it's not just a money issue. It's a fair use, copyright, and transformitive works issue.

SVA could probably have published the Lexicon with little difficulty if it used <10% JKR's own words, included meaningful and insightful commentary, and contributed something meaningful.

But it's not like that.

It wouldn't have been a problem if SVA had merely left it as a not-for-profit website-- copyright infringement usually only becomes an issue when attention is drawn to it, it becomes for-profit, or it's claimed that it ISN'T.

But SVA and RDR are trying to print it.

There's also the issue of protecting copyright; that is, if JKR/WB do NOT sue for-profit copyright infringement, they can "lose" copyright, and any Joe off the streets could start profiting from JKR's brainchild through pirating, selling non-authorized transformitive works, and generally screwing up Harry Potter for everyone.

Even if SVA is the "underdog" and "little man" in this story, the big boys and rich peeps are in the right, from a legal standpoint.

(Also, JKR is three shades of absolutely fantastic. <3 )

Don't be silly; for every crazy stalker fan, there's eight who're only mildly nuts, twenty who're just involved with the fandom, and a hundred who are JUST fans.
