...I hope this helps clear things up a bit. The obvious explanation for the states 'star' witness' apparent total ineptness, and why it took her 3 weeks to remember that she was even on the phone with Travon, and did not attend his wake, is that she didn't even know him. She was never really on the phone with him. Her phone was a welfare phone, issued to her, but it was being used by other gangbangers for drug activity. The gangsta using the phone could've even been in the same hood using Travon as a lookout! Upon following phone records, authorities ended up at her door. She initially denied that the phone was hers, then it was stolen, but when Al, Jesse and the lawyers got involved, they realized the tremendous propaganda value of the situation. So they coaxed her into remembering that she was Travon's friend, and that she was even talking to him while the incident was taking place...

It would be a judgement call. Can I outrun a bullet? Should I run or should I fight. What is my best chance for survival?

No bullet to outrun. You've already outrun the individual. No gun was produced until you went back and physically assaulted the other person. At which point, THEY were standing their ground because they couldn't get off the ground with you on top.

No! The D.A. makes the decision whether to prosecute or not. There are many homicide cases open as of this date because the D.A. refuses to take them to trial. If that rump doesn't get a signed confession he won't prosecute. He is afraid it would but a damper on his conviction rate and future job considerations!

While I don't carry a real pistol myself as a culture we've been BRAINWASHED into believing that "real men always fight fair".

What I think is "cool" and "chic" is carrying a heavy-duty Kimber mace gun IN TANDEM with a blackjack or numchucks or something and after you employ the first weapon you take advantage of your attacker's eye-tearing disorientation and immediately start sucker-pummeling him with the latter.

As a final coup de grace when the wakes-up from unconsciousness hours later he finds a custom lapel pin on him that says: "Did you know that the Marquis of Queensbury secretly boffed little boys EVEN DEEMED TOO YOUNG FOR OSCAR WILDE?!"

The department with which I am most familiar would have had the prosecutor on call on the phone and would have dumped that hot potato right into their lap. I predict they would have him charged with voluntary manslaughter before noon the next day and later plea bargain it down to involuntary after the storm died down.

I'll bet the overwhelming number of the open homicides you are talking about are "victimless" homicides
