Id understand if it was a crazy dog, but a mother cat and her kittens, this sissy shouldnt be any where near animals or a gun...

I would like to see him off the job until the hearing. Using a hand gun on a kitten that is a bit over the top. This guy should go, and to jail for the felony use of a hand gun.

Grasso is a retired union boliermaker and connected politically......big time. Nothing, I repeat NOTHING is going to happen to him unless this case is removed from the LA courts. Suggestion: drug testing should be mandatory for animial control officers carrying guns. Drug testing of Fred Grasso should be done now.

Here you go funny guy.... read until your little heart is content. Whatever class felony this is - I believe it falls into this situation.

353a. Aggravated cruelty to animals.

1. A person is guilty of aggravated cruelty to animals when, with no justifiable purpose, he or she intentionally kills or intentionally causes serious physical injury to a companion animal with aggravated cruelty. For purposed of this section, "aggravated cruelty " shall mean conduct which:
1. is intended to cause extreme physical pain; or
2. is done or carried out in an especially depraved or sadistic manner.
2. Nothing contained in this section shall be construed to prohibit or interfere in any way with anyone lawfully engaged in hunting, trapping, or fishing, as provided in article eleven of the environmental conservation law, the dispatch of rabid or diseased animals, as provided in article twenty-one of the public health law, or the dispatch of animals posing a threat to human safety or other animals where such action is otherwise legally authorized, or any properly conducted scientific tests, experiments, or investigations involving the use of living animals, performed or conducted in laboratories or institutions approved for such purposes by the commissioner of health pursuant to section three hundred fifty-three of this article.
3. aggravated cruelty to animals is a felony. A defendant convicted of this offense shall be sentenced pursuant to paragraph (b) of subdivision one of section 55.10 of the penal law provided, however, that any term of imprisonment imposed for violation of this section shall be definite sentence, which may not exceed two years.

In order to prove that an individual is guilty of Criminal Use of a Firearm in the First Degree, it must be established that the individual:

(1) commits any class B violent felony offense, and either:

(a) possesses a deadly weapon, if the weapon is a loaded weapon from which a shot, readily capable of producing death or other serious injury may be discharged; or

(b) displays what appears to be a pistol, revolver, rifle, shotgun, machine gun or other firearm.

Criminal Use of a Firearm in the First Degree is a B Violent Felony charge.
Criminal Use of a Firearm in the Second Degree 265.08

(1) commits any class C violent felony offense, and either:

(a) possesses a deadly weapon, if the weapon is a loaded weapon from which a shot, readily capable of producing death or other serious injury may be discharged; or

(b) displays what appears to be a pistol, revolver, rifle, shotgun, machine gun or other firearm.

ur all idiots!!!! he did his job and if people had more important things to do than sit home collecting government checks this wouldn't be an issue. when the same scumbags want skunks or raccoons out of thier garages or any pest, any measure would be fine. HOW WOULD YOU & WHAT WOULD YOU DO WITH A WILD AGGRESSIVE CAT& KITTENS??? we here in sunny LA our lucky to have such a service. GET A CLUE MORONS!!!!!!

wow they let a felon carry a gun??? what is this world coming to?
we let criminals roam free.
we put innocent people in prison for crimes they didn't commit.
we allow people to shoot animals for kicks...obviously they weren't "aggressive"...THEY ARE KITTENS for christs sake . a grown man with a gun afraid of new born kittens ? freaking wuss!!
of course the mother cat will be upset if you try to touch her kittens...but so would any mother of any species.

america is turning into nazi germany or communist china .
only a matter of time before they start throwing us in prison for utilizing our first amendment rights.
buy a gun now before they won't let us.....take it to the streets!
i have been saying it for two days now...WE ARE FAILING OURSELVES AS CITIZENS OF THIS SUPPOSED "FREE COUNTRY"

If anyone had hurt my baby {cat}, Charcoal, I'd have him strung up by his thumbs and have Charcoal scratch his feet. I know it sounds harsh, but what is harsher, a mama cat and two of her babies dying, or a few uncomfortable scratches on the soles of your feet?

That's why there are laws against animal cruelty, Mrs. Bernice. People DO abuse animals. Most serial-killers of humans start with animals. There ARE bad people in this world and "reason" isn't a part of their lives.

I am so sickened by this man'a actions. I can not belive he is still on the job & being paid, let alone carring a gun.He is supposed to protect God's creatures, not kill them.My heart hurts.......

He is NOT a felon, because he has yet to have his trial

And I doubt the DA can find a jury of 12 people where at least half of them dont hate cats

Maybe the cats were in such a state of suffering that the Warden made the decision to euthanize the cats by gun shot.
Everyone deserves the right to explain their actions before the public and media condems them.

This is my story with my run in with this man:
I had 2 of my dogs leave my home in Lackawanna at the end of April. I went out looking for them as soon as I noticed them both gone, my husband drove all of Lackawanna looking for them, then we left our doors opened all night including the screen door in case they came home they would just come in got up in the early morning and nothing still. My husband & I went right to Lackawanna police and told them and they told me that there was NO animal control working over the weekend so we would have to wait till Monday. I called, & called all weekend to see if Fred had my dogs NO call back, & NO called back from him. So we just looked and looked for our dogs called every shealter, & hosp. NO dogs any where. Finally about 2 weeks later I heard my 1 puppy was at a animal hosp. and the only way I found that out was a girl brought my one dog back to me after seeing a poster she told me she took him to Orchard Park animal hosp in hopes of finding his owner cause she knew he was a baby yet. So needless to say Fred knew where my ONE puppy was and DID NOT call me to tell me, he knew cause he told me that he knew the night the girl him there. So anyways I had NO use for him at that point. I have always lived in South Buffalo and dog control there has always been so helpful. My puppy ended up with parvo not sure how he got it, if it happened at the animal hosp. or what he did die 4 days after bringing him home, but them Fred went and told my landlord that my dogs were spreeding parvo in his park!!! My other dog is just fine and did not get it! The baby did not have the shot for it cause he was to young. Fred did nothing but treat me like dirt the whole of having to deal with him!! WHY cause of where I live? Because I live in a park does not mean we are dirt! The bottom line is you DO NOT kill any animal and that is the first thing he thinks of cause he wanted the hosp to kill my puppy and they would NOT do it! He is an animal KILLER!! And I am sure you will know who I am Fred when you read this!! This should be taken outside Lackawanna Courts for sure!!

If he did do this he should lose his pistol permit if he has one,be fired from job with no pension ect. Next prosecuted to the fullest extent of the law. Untill then suspened with out pay and remove any firearms or permits he has !

Your mayor thinks this guy did the right thing. He did not put him on leave, because he says he cannot find anyone to take his place..I guess he ran out of serial animal killers!
Not being from Lackawanna, but having dealt with your judicial system....still waiting for a decision..2 yrs later... I think the word corruption in all of your government agencies... is a kind word!
If I were you, I would run the hel* out of there and burn it on the way out! Good luck!

Come on, everyone, you must try to understand that little Freddie was either terrified of these poor kittens, had a bad time at home the night before or just wanted a chance to make sure his gun was working properly. Plain and simple, the guy is a heartless idiot and a coward... I'll know him if I ever see him by the yellow streak down his back. Take his gun away from him and put it where the sun don't shine. Not only does the mayor have Fred's back but says he did the right thing. LMAO. I mean it's an obvious lie but lets just pretend the mother cat was "viscous" what about the kittens??? Viscous kittens....lol. unreal. And not to mention this guy is still working as the animal control officer. I guess no one has the power to stop these people. I bet anythng he gets off scott free or gets a tiny slap on the old wristola. Wow, Lackawanna....what a great city. I'm moving first chance I get!
