1 Hudson family files suit against Jasper Brett King, Managing Editor, Jasper Journal 08.JUL.08 Teresa Powell Hudson, wife of Robert "Slick" Hudson, recently filed a wrongful death lawsuit against the Town of Jasper. Teresa Hudson is asking for $1 million in damages plus court costs. Robert Hudson, who was a county commissioner, collapsed from a heart attack at a June 25, 2007 county commission meeting. Hudson died five days later at Memorial Hospital in Chattanooga. The lawsuit claims the Town of Jasper showed negligence in their actions following the collapse of Hudson. The lawsuit also claims defibrillators that were purchased by the town of Jasper were not used and could have saved Hudson's life. "At some time prior to March 2007, the Jasper Fire Department obtained an Automated External Defibrillator (AED). The emergency personnel of the Jasper Fire Department at that time, including Fire Chief Paul West, were trained and capable of using the AED to deliver the required emergency care to a victim of sudden cardiac arrest, such as Mr. Hudson," the lawsuit reads. The complaint goes on to read, "Billy Simpson, the mayor of the Town of Jasper, told Fire Chief Paul West that he was not authorized to use the AED that was located at the Jasper Fire Department." The lawsuit referenced Tennessee Code 68-140-703, which states, "Any person or entity that acquires an AED shall, within a reasonable time after the placement of an AED, register the existence and location of the defibrillator with the emergency communications district or the ambulance dispatch center of the primary provider of emergency medical services where the AED is to be located." The lawsuit claims the Town of Jasper did not register the AED's location. "On the advice of (the city attorney) I have no comment," said Jasper Mayor Billy Simpson. Jasper's attorney Zach Kelley was out of town and could not be reached for comment. |

The county committee themselves voted out the registration of the AED due to the fact that if they had registered it they would have to respond to all heart attack victims in the city and it would cost the city to much money. Since they did not have it registered the mayor could not allow Paul West to administer any treatment with the AED. And if this went any other way, or if the city loses then everyone and anyone who has had a loss since the purchase and training of the AED that could have been saved with an AED has a law suit on there hands not just the Hudson Family... The city and lawyer needs to get it together! A local news channel had interviewed the city clerk after the insident and she went on to say that durring the meeting that they took the vote fot the AED she made the comment to them that she could not believe they would vote this out because one day it could be one of there family members it saves. Then she went on to say "but it was one of our own who voted against it"...Ironic isn't it? |

Robert Hudson, who was a county commissioner, collapsed from a heart attack at a June 25, 2007 county commission meeting. Hudson died five days later at Memorial Hospital in Chattanooga. The Hudson lawsuit claims the Town of Jasper showed negligence in their actions following the collapse of Hudson. In their answer, the Town denies any negligence. "Based on information and belief, it would be shown that a call was placed to the 911 Call Center. Shortly thereafter, an ambulance was en route and, within a short period of time and while the ambulance was en route, the call for the ambulance was canceled," reads the answer. "It would be shown that, at no time during this sequence of events, did anyone call or contact the Town of Jasper." One of the main issues in the Hudson lawsuit was the fact that Automated External Defibrillators (AED) were purchased by the Town of Jasper Fire Department. The original lawsuit claimed using the devices could have saved Hudson's life. The original lawsuit read, "At some time prior to March 2007, the Jasper Fire Department obtained an Automated External Defibrillator (AED). The emergency personnel of the Jasper Fire Department at that time, including Fire Chief Paul West, were trained and capable of using the AED to deliver the required emergency care to a victim of sudden cardiac arrest, such as Mr. Hudson." The Town of Jasper's answer admitted to purchasing the AED in March of 2007, but the answer also denied the claim that Jasper Mayor Billy Simpson told West he could not use the device. "It is denied that Mayor Billy Simpson told Mr. West that he was not authorized to use the AED that was located at the Town of Jasper Fire Department," the answer claims. "Rather, it would be shown that Mayor Simpson informed Mr. West that the town of Jasper was not qualified to provide, and would not provide, first responder service." Also, the original lawsuit claims the Town of Jasper did not register the AEDs with the Marion County 911 Center. "It is admitted that the Town of Jasper has not registered the AED," the answer reads. "It would be shown that Paul West did notify the Marion County 911 center that the Town of Jasper Fire Department was in possession of AEDs. It is denied that the town of Jasper's failure to register the AED is negligence. "It is denied that the Town of Jasper is guilty of negligence as alleged in the Complaint," reads the answer. |

Great for the city, sad for the family! People don't realize the damages done to a city when there are law suits filed. The fact of the matter is no amount of money will bring someone back, or make the pain go away it is just a way to put blame on someone else or take money away from a lot of other people. When someone dies of a heart attach whos fault is it really? It just has to make you wounder did the family do this just for the money or did they really feel he would be alive today if the city used the AED? Greed is a ugly thing.... |

The cardiologist told this family Mr. Hudson's live should have been salvaged.An AED was taken out and used on other victims in this area prior and after his death, therefore Mr. Hudson was not only discriminated agaist he was taken away from his family and the community.He was a county commissioner who was very well respected who tried to better his county, what a way to pay him back Billy Simpson.Who cares about taking money from people, Jasper's unorganized community failed to save this mans life.Life is more important than money to some of us.AED's are idiot proff! GO HUDSON FAMILY, maybe someone elses life will be saved in the future. Why have an AED if you aren't going to use it and save lives.
