A wise Judge used to say, What you've done speaks so loudly until I can't hear what you have to say. As far as speeding in a construction zone, you deserve what you get. Are you in such a hurry that you would risk making orphans out of some young children or a widow out of some fine wife by killing a DOT worker?? How would you live with yourself? I don't care where you get caught, it's irresponsible and there is no excuse for not being aware of your speed and the conditions on the highway.

I hear that so-called construction zone has been there since the 90's. I have read right here that there are no workers along I-95 in McIntosh County and Darien, it's just a way they can collect doubled fines. It's an old southern trick. I remember driving through there. Not a single worker or work vehicle, but plenty of orange barrels designating that part of the highway a work zone. The work was finished 2 decades ago. You southern crackers just want to keep the revenue flowing by raping the rights of people with out of state or yankee license plates. There is no one to make a widow of. You must be employed by McIntosh County, "sheldonater". Or some other cracker county in Georgia.

First of all you admitted you was speeding. Case closed. You broke the law.
These officers are out there doing their jobs day and night, missing holidays and birthdays, missing their family and risking their life for you an your family.
Part of an officers job is enforcing the traffic laws of the state. When you speed you put yourself and other peoples life at risk whether you mean to speed or not.
Officers don't get anything out of writing a speeding ticket, they don't get a medal or even a "good job" for issuing a ticket. They are just doing their job. If you work at burger king and youre told to flip burgers on the grill by the manager then that's what you're going to do. Same case with officers being told to write tickets.
You would feel completely different about this if someone had been speeding and hit your car with your whole family in it. This little inconvenient ticket you got could have saved your life.
Go look up the number of officers that have given their lives in the line of duty for you an your family this year. They are here to serve and protect, an if that means writing you a ticket for the law you ADMITED to breaking, then so be it.
Try putting yourself in their shoes.
You make $12/hour
Here's how a night at your job could go.
As soon as you get to work you get called out to a man threatening his ex wife with a gun and is trying to take her child.
After you hurry an eat your dinner you have to run to another call of two sisters fighting, one has choked the other and is punching her in the face. She also has warrants out for her and runs from you.
Your partner catches someone breaking into a place of business stealing items. You have to go assist him in the arrest.
10 mins before you're supposed to get off you get a call about a brother fighting his sister and saying he's going to kill her.
30 mins after you're supposed to get off work you finally get back to the office and start reports for all these calls.
You get home to your family 2 hours later than planned and are so exhausted you go straight to bed so you can get up and protect people again tomorrow, just so they can turn around and say your harassing them or youre out to get them.
Sound like a bunch of greedy, selfish people Out to write tickets an ruin people's lives? I didn't think so.
Try showing these officers who are just doing their jobs some respect.
Now to let you know, that was my night at work last night. Risking my life to keep people safe, however it may be. From writing a speeding ticket to breaking up a fight. From pulling people out of wrecks to drawing my gun on a man who pulls a knife out of his pocket.
Hope this helped you think a little differently about their intentions.

Ga law requires you to be going 10 mph over the speed limit to be stopped my a county or city. The only exception to this law is a state law enforcement officer. GSP is the only law enforcement agency that can stop you for 1 over unless you're in a construction zone or school zone.

Read the code section 40-6-181.

Learn your laws before you tell a cop he's wrong.

My husband was doing 76 in a 70. Period. The officer said he was doing 88. Lies. And I have heard from enough people to know that his is not an isolated case. He was mistreated and robbed. His car was ripped apart. He was moving to Florida, so he had it packed pretty full, and they tore it apart. In the end, they found no drugs, but that was their excuse. All they really wanted was the cash he could take out of the ATM machine. Since when do you have to lie to protect people?
I respect officers who are out there to protect people, but not officers who lie to rake in the money from out of state drivers. There is no aspect of protection there. The cars around my husband were passing him like he was standing still. They had Georgia tags and were driving way faster than him, but the officer picked him to pull over. The only reason is the out of state tags. Georgia drivers get a free pass. Not out of state drivers.
I might send an email to the national nightly news and see if maybe Diane Sawyer would like to do a piece on this corrupt town in that corrupt county.

What makes you think that the Georgia cops obey Georgia law? My husband was doing 76 in a 70. There were cars with Georgia tags passing him left and right, going much faster than him. There was no reason to handcuff him and drive him to an ATM to make bail, even though he was never officially under arrest and he was not read his miranda rights. It's called posting a cash bond. So he could either go to jail and wait for someone to bail him out or pay his bail himself. You can be arrested for any charge even speeding. That is not a violation of his rights.

Y'all all need to man up and take responsibility for your actions.

As far as out of state tags it has nothing to do with it. Granted they don't want to stop someone who lives in their county for the fact that a sheriff is elected by the people.

You can't argue with stupid. People don't take responsibilty for their actions and they don't understand the day to day situations officers face. Just moved to Lutz's husband must have done something to give the officers probable cause. They don't just arbitrarily select a car loaded down with stuff and plan to spend hours on the side of I-95 going through it. They have other things to do. If they were targeting out of state drivers, imagine how many citations they could have issued had they not been tied up searching his car.

You ignored the part that said he was never really under arrest. He was not read his miranda rights. He was not told he was under arrest. He was not fingerprinted. He was just driven to the ATM. His rights were violated, and the cop lied about how fast he was going. He was only 6 miles over the speed limit.

First of all having to place a cash bond you are not under arrest. You are detained until you post cash bond.

Second. You do not have to be fingerprinted for speeding. It's not a fingerprint able offense like driving suspended or possession.

Third. You do not have to be read your miranda rights if your not being arrested andtaken in for questioning related to a crime.

There are a lot of things that are more technical about your rights than you think. Take criminal justice classes if you'd like to know more.

This is the worst speed trap I have ever witnessed and the worse penalties I have ever seen in all my years of driving. I plan to write a letter to the Chamber of Commerce and GA Dept.of Tourisim.

On July 14, 2012 I was pulled over in Darien, Georgia in McIntosh County for speeding and supposedly I was doing 85 in a 70 on a 4 lane highway. I admit I was speeding but I was with the flow of traffic but because I had out of state tags and In a Cadillac Escalade with a British Flag tag on it the cop pulled me out of the bunch. The cops name was Officer Duck of the McIntosh County Sheriff's Department. I went to court in September to see what the judge could do for me and because I did not have the money to pay for the ticket they charged me $304 for the ticket plus they put me on probation which is something that I have never heard of and probation costs are $44 a month and I have to call every single week and check in with my probation officer like a common criminal. The judge at the time was a Retired Supreme Court Judge who was substituting while they looked for a new judge because the Judge was fired for an "unknown" reason. The judge told me that I DID NOT qualify for the super speeder ticket because the "law" was 20 mph over the speed limit. I recieved a letter on 10/15/2012 stating that I was found guilty of the super speeder law and I had to pay a $200 fine to the Georgia DMV by 02/06/2013 or my license will be suspended. I called the Georgia DMV and was inquiring about why I received this letter and the woman whom I spoke to said that iit was because I was doing more than 80 mph on any road in Georgia when the letter clearly states that i was doing at least 85 mph on any road/highway. So that right there clearly states that NOBODY in Georgia actually knows the exact law. Not the Judges, not the DA, and not the DMV. This to me seems like it is double jeopardy and that is unconstitutional and illegal. It is taking money from the poor and putting it into the hands of the rich. I am highly upset about this injustice about it. I have a clean driving record with no points taken off my license and I feel that this injustice of a law is ridiculous and unjust. I could understand it for someone who has a severely bad driving record. I have contacted the news in my local state, in Darien, Georgia, and In McIntosh County. So at the end of all of this I will be paying out $768 for the ticket and probation plus the $200 "super speeder" ticket which brings my total for a 15 mph speeding ticket to $968 plus some change. I believe the crooked judges of Georgia use some of that money to pay off their BMW's, Lexus, Mercedez Benz, and Range Rovers. This all reminds me of that song sung by Reba McEntire "The Night The Lights Went Out In Georgia" where the judge has blood stains on his hands.

If there is a class action lawsuit I would be more than glad to be apart of it.

Was driving on I95 S. County Officer was 30feet away from his car standing and talking to GA State trooper. Then he jump in his car pulled me over and gave ma a ticket 86 in 70. Writes in ticket that he used a laser radar to clock me (dont know how, he was not in his car and there was nothing in his hands) and I was driving with traffic. 4mi earlier there was 2 GSP cars sitting and didnt had a problem me driving speed limit.Seems like Mclntosh County Sheriff Dept in need of extra money and stopping people out of state to raise money.

If any body knows good Lawyer for a class auction lawsuit I want to be in it.

You are EXACTLY right in calling them names. It's the WORST law enforcement in Ga. They long ago took over Ludowici and Long County for that prize. It's a shame too because it's a beautiful place but it's run by MORONS. Always has been...The cops are all idiots (just go to a festival like Blessing of the Fleet and watch them flounder around, chase tail, and smoke cigarettes everywhere they walk) It's time for ANOTHER federal investigation of the place, it looks like.

So, in 2012 the preactice lives on. I was passing a car, and in order to pass you must speed up, go around and come back in. I did that and I did notice I hit 15 mph over during the pass manuever. Ironically, I was getting passed fast and furious by all sorts of drivers as well. So when the cops cars that were LINED UP and waiting, started to pull out, I was in the middle of a group of cars, many going much faster than me and the cop followed for over a half a mile going lane to lane and I knew I would be stopped. I glanced around and I was the ONLY one with out of state plates. Sure enough. Ticket $400 plus another $200 later on to the State of GA a few months later. When the cops make choices, and follow for distances and people are still passing me, it is a speed trap pure and simple. A very lucrative one. They had county cop cars lined up to pull right on in as the others pulled out. This is a very efficient shake down program. Not a construction zone, etc etc. No judgement other than who is most likely to not travel back and contest this farce - the out of towner. So I got screwed. I used to live in GA many years ago, nice to know nothings changed, now I remember why I left.

I was stopped a couple years ago in Darien. It seems that my tag light was not burning. While awaiting my
case in court, I met several out of town folks that were protesting having such heavy fines. One gentleman from Atlanta returned to fight his fine. He was charged $850.00. He was armed with a printout from the American Auto Assn. It stated that the average fine in the United States for speeding was $150. The average High fine was $250. Darien was almost five times the average High fine. The best he
could do was to get it reduced to $750.

I fared somewhat better. I asked the judge to see the evidence against me. The deputy was only witness. I told the Judge that I had a witness that was in Michigan, and I needed the court to subpeona that witness for my case. Furthermore I asked the court to provide transportation for my witness so that I had a means of defending my case.

The judge dismissed my case.

I learned from this that even thought there are some very good resturants in Darien, I will not be patronizing them because I see how they truly are.
