Question: since this "Basketball School" is leasing the church gymnasium, does the church now become commercial property and have to pay property taxes? Or does it retain its tax exempt status, which means we get no sales tax and no property tax, but our paramedics have to respond to every injury that may occur? Is this growth? Or a burden on all of us?

Funny, AandG, where in the linked article does it mention that Adam has ANY pretensions of representing VOL (or any other municipality, for that matter?)

Unlike Burt, of our current VOL law firm, who not only practices election and muni law, but also expanded into banking. Still a Director of the holding company that owned all of failed New City Bank, according to their latest Form D filing. A bank failure that cost the FDIC over $17M.

Didn't VOL have a loan from New City Bank, at least until it was refinanced into the 2012 oh-so-private debt certificates? And Wait, didn't VOL issue a 2012 Debt Certificate Payment check on the January warrant to Burt and his wife for $4851.07 (check #62546)?

Seems to me the two firms - as far as their past history with Lyons goes - are two sides of the same coin.

Answer: "Even though an organization is recognized as tax exempt, it still may be liable for tax on its unrelated business income. For most organizations, unrelated business income is income from a trade or business, regularly carried on, that is not substantially related to the charitable, educational, or other purpose that is the basis of the organization's exemption."

This is the IRS ruling which would seem to indicate that the portion of the property used for financial gain would be subject to property taxes. But it would take a lawyer to answer that for sure.

You're welcome. Interesting caselaw on this. Fairly clearcut, though, since The Althlete Within Basketball School is incorporated in the state of Illinois as a for-profit LLC.

I'd like to know how President Gatz and Clerk Campos, who are both on the ballot to be reelected, sit on the election board that removed Mr. Gatz from the ballot? Of course they would throw him off the ballot in order to give them an edge. I believe the Election Board should be comprised of individuals not running for office.

Well, here's more drama - feel free to tune out!
Just got back from ZBA meeting: Family Dollar is looking to locate in the old Walgreen's building. Would mean additional property and sales taxes, although some would be captured by TIF 3.

FD is planning (much needed) upgrades - both structural and cosmetic - to the building and site.
One possible fly in the ointment is that they will almost certainly be offering far lower prices than either Walgreen's, CVS or local convenience stores, so it will be interesting to see what objections surface when this comes before the Village Board (a week from tomorrow, perhaps?)

I see a Public Notice for a "special use" for 8100 W. 47th Stret for trucksales and repairs. Isn't there someone there already doing that? If it is the same person as the applicant, then this would be a "self imposed hardship" and the request must be denied. You can't do something that requires ZBA action and Board approval and then ask for it after you have already done it.
