What's the difference? I don't care if they're holding it in their hand or not. They are distracted while driving.
If it is hands free, it is no different than holding a conversation with the person sitting next to you in the car. Do want them to legislate conversations in moving vehicles?

The problem is people's ability to task load. Some people can do multiple things simultaneously without any problems. For others, they can't seem to chew gum and drive at the same time. So, it is not so much the task, as it is the ability of a driver to handle them in combination.

Instead of singling out cell phones, the most fair way to handle this problem is for law enforcement officials to start citing drivers who are distracted. If you can drive while talking on the cell phone, reading a book and eating Chinese food with chopsticks, then you should be able to, provided you keep up with the flow of traffic and stay in your own lane.
