New employee goes to take drug test there.
Shows the girl his script for a drug that they don't even test for. Totally legal, he shouldn't have told her, but they ask so he told her.
She said "you need to tell the company that you're on this" and he said "no I don't! I didn't even have to tell you"
Well, I'm pretty sure that she screwed up. Because she went and told the boss to ask him what he was on. He told me, I told the employee and the employee told a lawyer.
MED one on volunteer parkway .....
Got the name, date. And what was said.
Don't look good for the girl. I think that's federal too, right? Isn't that HIPPA?

really now? med one closed down over 2 weeks ago so when exactly did this happen? and whats the big deal? if he has an RX for the drug then he should have kept his mouth shut or been up front with the boss.

Was me done the one near walmart? It happened more than two weeks ago. About 2 months ago.
And you're right. He had scripts. The point is, she broke federal law for making that comment to the employer. I'm sure of it. I think she can still be prosecuted and he's after her.
But I must admit, I'm not exactly sure of the location. It wasn't me.
But I did look it up. It's a $5000 fine and as federal offense and he is perusing it.

I bet the had the urine tested for therapeutic value; meaning they tested the amount in his system against the prescribed amount. That be said if you are over then you're abusing the medication and is in fact a failure. Common HR practice for the second test and not illegal at all. Should read a drug exam form before signing and donating the sample.
Hope "he" isn't putting to much cash out on that lawyer. Fool and his money are soon parted.

GODD and accurate information, yet doesn't apply here. The applicant only "stated" that he was on a legal prescription of which they do not test for,. Therefore there would not be elevated levels, and therefore not a failure. Most of these administrators don't call when they are supposed to and here is one calling hen she's NOT.
Now if there was a failure of any kind he wouldn't be employed (excellent employee by the way). She likely didn't know it, but the person she called's wife is an attorney and is quite certain that she broke federal law. That's not a civil case. That's just an arrest. He didn't get a lawyer, doesn't need one. Sounds like she does.
It violates HIPPA and they simply arrest her or serve her. Imagine that. An office worker calling an employer to inform the employer of a a legal drug that he's taking with a prescription,
No, she's in trouble , a fool and their career are soon parted.

He has a case. If he can get a statement that the girl from med one called and said " you need to ask him what medication he is one" then that's pretty much her ass.
Her job is pass or fail, nothing else.
Sounds like a busy body bitch. Probably thought since they were going out of business, that she wouldn't get into trouble. That's federal law. This ain't no stupid Ron Ramsey bullshit. This is real.
