Nuclear plant security supervisors sue Entergy over unpaid overtime wages

Hourly employees who provide security services at the nuclear plant facility in Kilona have filed a lawsuit against Entergy in an attempt to obtain compensation for unpaid overtime wages.

Stephen Allen Jr., Ernest Brown Sr., Felicia Connor, Nathan Hills III, Cynthia Johnson, James Kelly, Wayne Lacy, Steven Looney, Douglas Luke Jr., Rolando Martinez, Billy Mooring Jr., Jonathan Perry, Charles Ryan, Tharon Simon, Cynthia Robinson Singleton, Anthony Smith, Michal Stubbs, Douglas Valotta, Lee Vicks and Picola Williams filed suit in federal court in New Orleans.

The suit accuses Entergy of willfully violating the Fair Labor Standards Act and of having a history of violations of the overtime compensation requirements of the FLSA.

The employees are asking the court to prevent the defendants from further violations of the Fair Labor Standards Act and for an award of compensatory damages, liquidated damages, attorney's fees, costs and back pay.

The plaintiffs are represented by R. Glenn Cater and Amanda C. Graeber of Cater & Associates in New Orleans and Chris Edwards in Gretna.

U.S. District Judge Sarah S. Vance is assigned to the case.

The VT employees supposedly suing VT are barking up the wrong tree. They should be suing Entergy for 'monumental incompetance'.

Entergy has a history of scewing employees... especially security. The VT supervisors that are suing are doing so because of hundreds of hours of unpaid overtime! They were told minimal overtime, they have direct reports that make in some cases more than they do with better benefits!! But the real issue is that Entergy is in violation of the FLSA federal labor law, regarding classification of exempt employees. Security is the only dept at vy that does not pay thier salaried supervisors at least straight time for OT after 40 hrs! They give the security supervisors a bonus based on plant performance, but it is taxed at 46% and it in no way makes up for in some cases 500 hrs of OT a year! Every entergy plant has labor problems of some kind.. small wonder eh?

Mike, we are upset over entergys dishonesty, and abuse of Security Supervisors,and violations of the FLSA, but this doesnt mean I want to harm, or somehow malign the company. There are a lot of good people working at VY. We just want whats right, and fair. I think you and I have different agendas.

Remember the good old days, when theVY security officers and me conspired to shape the security stance of the plant over decades through strategic leaks.

I remember when a security officer's leak to me cause the NRC to force VY to spend millions of dollars on forcing them to update their main security gate...We got it replaced within a year of time.

Does anyone know if the judge assigned to the case has ruled on whether the supervisors are exempt employees or non exempt??

Yeah, they were found to be nonexempt...or eligible for overtime pay. The judge has issued the order on the verdict, no new trial,

Entergy has now re-classified all Security Shift Supervisors across their entire nuclear fleet as non -exempt or hourly. They say it is not because of all the ongoing litigation, and they admit no wrong doing or guilt, regarding violating federal labor laws. Entergy has filed an appeal in the lawsuit at Vermont Yankee in which a jury found them to be in willful violation of federal labor law. Entergy filed motions to get the verdict tossed out,and for a new trial. The federal judge up held the Jury`s verdict, with the exception of fluctuating work week which applied to two of the four men in the suit. Fluctuating work week allows Entergy and other employers to only pay half time of a reduced hourly rate for hours over fourty in a given week. This saves employers a lot of money in overtime expenses.
