"For the reasons stated above, we AFFIRM the district courtís grant of a declaratory 3 judgment that Act 74 and Act 160 are facially preempted by the Atomic Energy Act."

I wonder how long Shumlin and company will flog this dead horse? They now may just wait until the CPG is complete.

I wouldn't go that far, it's still costing Entergy a lot of $$$ to litigate this.

I'm sure the anti-nuke nutbags are already working on how to spin this as a victory.

Let's petition to have the bill for this silly case sent to Shumlin and Sorrell. It was an obvious loser from the get go prosecuted for purely political reasons. Maybe Shumlin has enough funds in his Senatorial campaign fund to pay for this debacle.

His liberal arrogance is what got us into this. But I agree he was not smart enough or experienced enough to advice Shumlin and the democrats that their attempt to get VY through Act 160 was both unconstitutional and impractical.

From the fall of 2012:

"If the board accepts the MOU, the utilities will have to produce $2.5 million in savings for their customers in that first year. The next year it is $5 million. The utilities are required to verify $144 million in savings to customers. The $21 million in investments in efficiency, about $12 million of which will go to weatherization programs, is supposed to yield $25 million in benefits to customers through reduced electricity use."

Where's Shumlin and the Legislators crying "Liars" at GMP and the PSB?
