Attorney: Brainerd woman won't pay for sharing songs

Didn't she buy the songs? If so, then isn't she free to do with them as she wants?

In any case, the fine is unbeleavable. Fine her in accordance with the actual "damages suffered." Which would be around zero to maybe a couple hundred dollars.

Never claimed to be perfect. Do I sometimes speed? Sure. And if I get caught, I pay the ticket. No one to blame but myself. She knew what she was going was illegal, yet she did it anyway. Plenty of people do it, but she got caught. Deal with it. Will she have to pay the amounted requested? Not likely, as some settlement will be reached, but she is not the victim here.

I think conidering she had the chance to settle this case more than once the last time for just $25,000 and now being found guilty by a 3rd jury. She gets what she deserves.

At the same time though, the prosecution really hasen't proven their case. They've shown no profit, burned CD's or hard drive containing these downloaded songs.

She is definitely guilty but where's the proof. Sounds like a wash to me.

I agree. She needs to man up. This is not her first rodeo at screwing someone out of what they earned & is legally theirs.

The amount is ridiculous. It's more than the cost of one CD. IMO make her pay for the CDs and that's it.
