She got pregnant and found out... her dear husband was an illegal and those papers were fake... now he is always telling her if she files for divorce he will accuse her of knowingly married him and she will end up in jail plus he will take the kid away.. he has become an a###hole and I have tried to help her but she is afraid to go to jail and to lose her child.... he lie, he use her and he expects to get his papers... and to make things worse he might have a family back home... this is one of the reasons why I am so fired up to fight the illegals this kind of things should have never happen.... I feel for you and my dear friend but soon all this will stop America will wake up....

Okay, this entire post just ticked me off. Number 1, tell your friend to stop being a victim. The bottom line is that she is a battered spouse, abuse does not always come in the form of physical, emotional is just as bad. If he does not have legal status he is not about to get mixed up in the legal system for a custody case. It does not matter whether he is married to a U.S. citizen or not, he is ILLEGAL and will continue to be ILLEGAL until he has a green card in his hand, and then it is CONDITIONAL on the marriage. He will have to hold that greencard for several years before he could adjust to nonconditional. If your friend has already filed the paper work she can rescend the application. At the very least she needs to move out of the house and file for divorce or at least separation to get it rolling. It does not matter if she knew he was an illegal or not when she married, the big question is whether it is a valid marriage, if she married him in good faith on the idea that it was a loving union. The only way fraud would come into place is if she only married him for him to obtain legal status and since they have a child together I am guessing that was not the case. She will not go to jail, in fact at the interview DHS always states what the law is and offers immunity to confess that it is a fake marriage. Another thing, if he entered this country illegally he cannot obtain his papers in the U.S. he will have to return to Mexico for all the prep work and final interview, which will be denied due to the fact that he was in the U.S. illegally. He will be barred from re-entry from 3-10 years and she will have to file a statement of hardship which may or may not be approved. Now for my devious side, if she really wants to be done with him here are a few suggestions. If he drinks and drives, wait until he gets behind the wheel and then call the police and report the license plate as a drunk driver. Check your domestic violence laws for your area. Most places will now automatically arrest on just a claim without physical evidence. When they come out she is well within her rights to report to the police officer that he is an illegal alien. Also in this instance do not take anything from his wallet as that fake I.D. and fake social security card will work in her favor, he will be flagged as using fraudulent documents. The pregnancy and child negates any claims he can attempt to make, it is a valid consumated marriage. He is not going to make it across the border without a birth certificate and divorce decree granting full custody or parental permission from the the missing parent. Also possession is 9/10 of the law, as long as she has the child with her he CANNOT take the child from her without going through the courts. On the downside she also cannot leave the child with anyone that he knows such as baby sitter, friend or family as he could demand the child and they would have no legal recourse but to hand the child over, and then she has lost her standing. Another option, it sounds like she has valid grounds for a restraining order, of course if she claims domestic violence and he is arrested that is generally a standard part of the arrest record. The biggest problem in cases like these is getting the woman to actually take action, it never ceases to amaze me how many women stay in an abusive relationship. bigsmileana wrote: <quoted text>I will pass this along to her. Contact the Immigrations and Customs Enforcement office with jurisdiction over where you live. You may also try sending a written letter.

well...my peruvian spouse had a temp green card due to marrying me as a us citizen. once he saw i wasn't gonna put up w/his crap, he joined the army...guess he wanted to use that as his road to perm residencey since he is serving in a time of war. i turned his fake ssn, and alot of other stuff i found out about him over to the INS. hope once the army is done w/him and his deployment...they will deport his a$$. it has been the most hurtful thing i have ever experienced. and i have been thru alot. it's disgusting.
